European Union and its Neighbours in a Globalized World

This open access book presents a thorough, multidisciplinary examination of children’s rights in Central and Eastern Europe (CEE) with a focus on Lithuania. Pursuing a comparative approach, it explores various aspects of children’s rights as established in constitutional, civil, administrative and criminal law in the region, while also discussing emerging issues. The book shares unique insights into the challenges and progress specific to individual CEE countries, many of which have undergone significant political, social, and legal transformations in recent decades. The comparative analysis of practices and legal frameworks between Lithuania and other countries in the region and across various CEE countries is a key feature of the book. By comparing practices, case law and legal regulations across different CEE countries, it highlights both the diversity and the common challenges in the region. Moreover, such a comparative perspective is invaluable for policymakers, practitioners, and academics in terms of identifying best practices and learning from different countries’ experiences. The respective chapters offer evidence-based insights and recommendations to guide the development of more effective and rights-based approaches to child protection. While aiming to enhance awareness and understanding of children’s rights, the book also seeks to fill a gap in the literature by focusing on the CEE region, an area often underrepresented and overlooked in global discussions on children’s rights. Bringing together a wide range of theoretical and empirical research from Lithuania and other CEE countries, it features contributions by researchers from the Baltic states, Poland, Slovenia, Hungary, Croatia, and Romania to provide a more holistic understanding of the challenges and advances in children’s rights in the CEE region.

This book considers what kind of binding force judicial decisions (should) hold in modern societies. It focuses on the two most prominent legal traditions, common law and civil law. It explores the developing trend in civil law countries to expand the influence of judicial precedents, discusses the fundamental issues which arise from this trend, and looks at recent developments in common law countries. Through this prism, the book looks at the implications of the doctrine of judicial precedents and how it is construed in jurisdictions that recognise it. It investigates the impact of newly recognised legislative or quasi-legislative powers vested in high courts on the doctrine of separation of powers. It considers whether courts in common law and civil law systems share a uniform understanding of precedents. The book goes on to consider whether these developments are beneficial when it comes to addressing existing challenges or whether they lead to a host of new problems, potentially exacerbating the crisis of judicial legitimacy. In relation to the hierarchical nature of civil law justice systems, it asks whether binding rulings from higher courts pose a potential threat to substantive judicial independence, limiting the open and pluralistic dialogue between lower and higher courts. It then goes on to reflect whether binding opinions from the highest judicial instances encroach upon the prerogatives of legislative bodies, resulting in the creation of suboptimal laws.

The rules-based international economic order is undergoing profound transformation. Geopolitical risk and geoeconomic strategy are no longer external shocks to a stable system; they now shape the core of international economic law (IEL), influencing trade regulation, investment protection, digital governance, and supply-chain design. Tariffs, sanctions, investment screening, data controls, and security-driven regulation have become structural features of the global economy.
This edited volume originates from the 9th Asian International Economic Law Network (AIELN) Conference, held in Tokyo in June 2025 under the theme “Geopolitical Risks and Geoeconomics in International Economic Law: Asian Perspectives and Beyond.” It brings together scholars, practitioners, and policymakers to examine how IEL is responding to persistent geopolitical uncertainty and regulatory risk.
The chapters analyze how legal frameworks allocate the costs of geopolitical and regulatory risk, whether the liberal trading system is fragmenting into regional or minilateral arrangements, and how security, resilience, and sustainability are reshaping market access and investment governance. A central question is whether international economic law can adapt to these pressures without abandoning rule-based multilateralism.
Placing Asia at the center of the analysis, the volume explores whether Asian states can move beyond being objects of great-power strategies and instead act as norm entrepreneurs shaping the future of international economic law.

Following the events of 9\11 individual countries and the international community became increasingly concerned about how best to prevent the funding of terrorist groups. Alternative remittance systems such as Hawala, where money is moved informally between a network of brokers in the Middle East, north Africa and south Asia have been identified as a potential source of terrorist financing leading to calls for greater regulation of such alternative remittance systems.This book analyses the risk such alternative remittance systems pose in terms of terrorist financing, offering a detailed overview of the historical origins and methods of operation of alternative remittance systems or informal value transfer systems. The factors that have come to ensure that these systems have remained operationally viable in modern times are identified along with the risks they present balanced against an overview of their actual misuse for illicit purposes to date. The book presents a detailed critique of the UK framework for the regulation of these systems drawing where possible on existing data to assess the use and effectiveness of these measures in practice. A range of options for mitigating risks associated with specific remittance corridors is considered ranging from initiatives that promote remittances through the banking sector, to efforts to mitigate risk and the impact on the delivery of UK overseas development aid. The book concludes with key recommendations as to the effectiveness of the current regulatory framework within the UK viewed from the perspective of international efforts to secure the regulation of these systems, and in stemming terrorist finance as part of national and international counter-terrorism policy.

The system of provisional measures in investor-State arbitration can be divided into ICSID arbitration and non-ICSID arbitration, and comparison and anatomy can be conducted within the system. In addition, it is interesting to see how these issues are dealt with in the interim measures taken by the ICJ. In view of this, this book intends to compare the provisional measures in the ICSID arbitration and non-ICSID arbitration within the investor-State arbitration system, and compare the provisional measures in the investor-State arbitration with the interim measures in the ICJ, so as to anatomize the system of provisional measures and provide some guidance for the international lawyers in their future arbitral (judicial) practice.

Provisional Measures in Investor-State Arbitration and China’s Legal Practice

The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.
