The contributors analyse the dynamic interplay between democracy and law within a Japanese-German comparative framework. Emphasis is placed on the democratic legitimacy of legislation as a prerequisite for societal acceptance and on the role of enacted norms in shaping administrative and judicial practice. The volume examines the structure of the democratic principle, the interaction of public law and private law mechanisms, and their combined relevance for modern democratic systems.
 

 Historical developments, legal-philosophical perspectives, and theoretical foundations are discussed, showing how Germany and Japan, despite distinct cultural and institutional traditions, have incorporated elements of the Anglo-American legal sphere. The symposium builds on earlier joint research initiatives and extends the analysis of legal governance in selected fields of law. Particular attention is given to the comparatively unexplored significance of procedural norm implementation for the functioning of democratic orders. Further chapters address economic, labour, and social regulatory frameworks, the tension between market freedom and social responsibility, and emerging security issues, including those in civil protection law. European and international dimensions of democratic guarantees complement the discussion. Against the backdrop of global political developments, the theme "Democracy and Law" proves its continued relevance for understanding and developing constitutional democracies.

European Union and its Neighbours in a Globalized World

In Europe, the digital landscape is undergoing significant transformations, driven by both technological advancements and regulatory changes. The primary challenges lie in managing the influence of dominant large platforms while striving to create a fairer, more accessible, and competitive European digital market. In response, the European Union has initiated a regulatory revolution with major legislative acts such as the Artificial Intelligence Act (Ai Act), Digital Markets Act (DMA) and the Digital Services Act (DSA). The book deals with the impact of these regulatory systems in selected Eu Member States.
Given the significance and cross-disciplinary nature of the topic, the book is divided in two main sections. The first section addresses the recently approved Artificial Intelligence Act and its impact on the regulatory framework and administrative systems of the specified Member States. In light of the increasing integration of artificial intelligence within the public sector across Europe, this section examines the existence of national legislation in the relevant countries and its relationship with the AI Act. Furthermore, this section investigates the organizational and institutional changes in the selected countries, as well as the reinterpretation of traditional principles of administrative law or the creation of new ones to align with the provisions of the Regulation. The second section delves into the complex landscape of the newly introduced DMA and DSA, focusing on the various institutional arrangements adopted by Member States and their national competent administrations to support this new EU legal regime. &nbsp;It provides a comprehensive and detailed understanding of the national-level implementation of these regulations and their implications, highlighting the institutional interplay and the complexities of effective regulation in the digital age.

Organisierte Kriminalität (OK) gilt seit Jahrzehnten als erhebliche Bedrohung für Rechtsstaat und Gesellschaft. Bereits in den 1990er Jahren wurde ein Konzept geschaffen, um diesem Phänomen mit Mitteln des Strafprozess- und Strafrechts zu begegnen. Die Arbeit untersucht, ob mit diesem Verfolgungskonzept auch eine Bewältigung heutiger OK-Strukturen gelingen kann. Dazu werden dessen Entwicklung, dogmatische Grundlagen und Anwendungsfelder systematisch aufgearbeitet, kritisch bewertet und schließlich ein Vorschlag zur Neuausrichtung der OK-Ermittlungen entwickelt. Die Arbeit richtet sich an Wissenschaftler:innen, Praktiker:innen und Entscheidungsträger:innen im Bereich des Straf- und Sicherheitsrechts.

The second edition of the book provides a thorough legal analysis of sovereign indebtedness, examining four typologies of sovereign debt – bilateral debt, multilateral debt, syndicated debt, and bonded debt – in connection with three crucial aspects: genesis, restructuring, and litigation. Its treatise-style approach makes it possible to capture in a systematic manner a phenomenon characterized by high complexity and huge multidisciplinarity. Because of this complexity and multidisciplinarity, the legal analysis is not exclusively based on international law, but also includes private international law, domestic law and financial practice. To better contextualise the phenomenon, references are made to international financial relations and international financial history. Although it follows the structure of a continental&nbsp;tractatus,&nbsp;the work presents a good balance between doctrinal and jurisprudential sources, making it a valuable reference book for scholars and practitioners alike.
 The main updates in the second edition include:&nbsp;the effects of the Covid and Ukrainian crises and the Puerto Rico default; the issue of the validity of the Mozambican, Ukrainian, and Venezuelan loans; an analysis of China’s lending policy with particular reference to Africa; a description of the Asian Infrastructure Investment Bank and the New Development Bank; the role of credit rating agencies in the bond issuing process and the ICMA Principles on green, social, and sustainable bonds; the place of marine conservation swaps and climate swaps in restructuring processes; an inquiry into the legal status of the Paris Club and an illustration of the 
 ad hoc
 terms for restructuring and the Debt Service Suspension Initiative;&nbsp;the inclusion of single-limb collective action clauses in the terms of the bonded loans; the conclusion of the lawsuits brought by vulture funds before the US courts and of the ICSID arbitrations instituted against Argentina; and, finally, an account on the Paris Club Common Framework and the UN Basic Principles on Sovereign Debt Restructuring.

Focusing on the basic scope of the law of democratic management of enterprises, this book aims to explore the legal discourse system of democratic management of enterprises. Based on the study of theories of economic democracy and labor cooperation, this book proposes the theory of labor co-construction, and explores the theory of enterprise consultative democracy proposed in our official documents. The logic of this book lies in the construction of the discourse system of the enterprise democratic management law by including the workers' representative assembly, the workers' directors and supervisors, and the workers' shares in accordance with the conjunctive relationship between labor and capital. This book is suitable for graduate students and researchers in labor law, corporate law and labor relations.

Robert Lamersdorf examines fiduciary relationships-relationships in which one party has both the power and the duty to pursue and safeguard the other party's interests to the best of its discretion. Fiduciary relationships are of great intrinsic and instrumental value. Yet the power held by a fiduciary entails manifold opportunities for abuse. From the perspective of comparative law and with reference to U.S. fiduciary law, the author explores what legal safeguards are required, in view of the risk of abuse, to enable a productive fiduciary cooperation. In doing so, he focuses in particular on the limits of what the law can achieve directly. One core thesis is that coercion, liability, and sanctions create indispensable counter-incentives to the abuse of power, but can secure trust and loyalty only to a limited extent. Effective cooperation in a fiduciary relationship instead depends to a significant degree on an extralegal normative infrastructure that can be described, in summary, as a "culture of trust." This includes internalized social and moral norms, social roles, habits, dispositions, and basic assumptions. Robert Lamersdorf shows that this constitutes a form of social capital that bears the characteristics of a public good and is therefore threatened by underinvestment and negative externalities. Building on this, he develops a further thesis: fiduciary law has a regulatory function, namely to protect and preserve this social capital and thus the public good of "trust in fiduciaries."

Legislative Research on the People’s Supervisor System

The German-Japanese Colloquium on Administrative Law institutionalizes and strengthens the long-standing connection between German and Japanese administrative law scholarship. This volume brings together the contributions of the 2nd German-Japanese Colloquium on Administrative Law, which took place at the University of Tokyo in April 2025, two years after the inaugural event in Heidelberg in 2023. This volume focuses on administrative procedures in transition, taking into account governmental, administrative, and judicial aspects. New requirements for efficiency, transparency, and participation are changing the structure of procedures and challenging the legal systems of both countries. The following topics are covered in detail: administrative court legal protection between subjective legal defense and objective legal control, functions of administrative procedures in transition, errors and consequences of errors in administrative procedures, and administrative functions of the government. Further attention was paid to the current reform discussions on the acceleration of administrative procedures in Germany and on informal administrative action in Japan.
