Rome Statute of the International Criminal Court

Sexual violence in conflict, often referred to as conflict-related sexual violence (CRSV), refers to some form of sexual and/or reproductive violence perpetrated against women, men, girls and boys that is directly or indirectly related to the conflict. This includes rape, sexual slavery, forced prostitution, forced pregnancy, forced abortion, enforced sterilisation, forced marriage, and any other form of sexual violence of comparable gravity. The perpetrators of CRSV vary between each case and include state and non-state armed groups, including terrorist organisations. This book examines some of the recent manifestations of sexual violence as atrocity crimes, and especially, prohibited acts to bring about genocide, the responses to these crimes, and issues that continue to be neglected, including in relation to the duty to prevent. The work structures the discussion around the prevalence of CRSV, its use as a tool of genocide, and other international crimes, and the failures of legal and institutional responses. By combining thematic chapters on international law and accountability with case studies, the study provides a balance between theoretical critique and empirical analysis. It further engages with the debates on what is needed to bring about change, looking at specific policy and law reforms. The work also examines the way forward, including recommendations to introduce an international convention specifically focused on CRSV, and a permanent mechanism on CRSV. This book sets out a legality-centred model to better understand the interpretation of crimes in international criminal law. It offers a new way of understanding the interpretation of crime as a two-dimensional process: determining what the law is and interpreting whether that law in fact criminalises the conduct in question. This model affects the process and the outcome of judicial interpretation. The book moves beyond the abstract by applying the model to two case studies: (1) organisational policy as a contextual element of crimes against humanity, and (2) the crime of forced marriage. It brings often-overlooked criminal law theory into the field of international criminal law, offering a fresh, innovative perspective on interpretation and placing the legality principle back at the centre of crime interpretation.

Judicial Discretion in the Interpretation of International Crimes

This open access book asks whether international economic crime can qualify as an international crime and be prosecuted as such. Taking a four-part approach to the question, it traces the origins of the concept of international economic crime, and draws the line between ordinary economic crimes and economic offences of international significance. To this end, it examines six cases involving the commissions of serious economic crimes in different regions of the world, including Europe, the Americas and Africa: the crime of grand corruption in the Petrobras case; the theft of natural resources in the Niger Delta region and Liberia; the international money-laundering scheme in the Bolichicos case; the crime of financing terrorism in the Chiquita case; the Volkswagen conspiracy case in the US and the Haarde case related to gross-negligence in preventing serious economic damage. It then goes on to discuss a potential sui generis category of international economic crimes, before considering the advantages and the challenges of the multilevel enforcement system of international criminal justice in prosecuting such crimes. This book provides an innovative and original avenue for the analysis of a controversial and yet overlooked topic in international criminal law. Theorising a New Paradigm of Mass Criminality

Systemic Economic Offences as International Crimes

This book offers a critical view of the punitive bias in the case law of the Inter-American Court of Human Rights, demonstrating the delicate relationship between Criminal Law and Human Rights. Based on cases involving the performance of the Inter-American Court of Human Rights in situations in which States failed to punish perpetrators of crimes - and, consequently, victims were considered unprotected by domestic law -, judicial constructions are presented that punish such conduct by States, regardless of principles and values ¿¿of individual guarantee aimed at protecting citizens against the punitive power of the State.
Throughout the book, the characteristics of the Inter-American System of Human Rights and how cases submitted to it are handled are analyzed. It presents the relationship between criminal matters and the protection of Human Rights in International Law, highlighting their points of intersection. Then, based on the analysis of selected cases (many of which occurred during Latin American dictatorships), the main theses developed to justify the use of criminal law as the main (and sometimes the only one) way for the State to act in favor of the protection of human rights are highlighted.
From there, criticisms are made of this jurisprudence, highlighting in particular: the problematic conception that Criminal Law is a suitable means of satisfying the desire for justice of victims and their families; the mistaken view that criminal proceedings are the best means of knowing the truth of the facts; the fight against impunity as the sole purpose of criminal proceedings; the disregard for the guarantee of the principle of criminal legality, whether by the malleability of what is considered a crime, or by the "revocation" of causes that extinguish criminal liability, such as amnesty and prescription; the flexibilization of extradition treaties; the excessive interference in criminalization orders directed at States. Based on these findings and supported by international doctrine, the aim is to demonstrate the approximation of the law produced by the Inter-American Court of Human Rights with the doctrine of the criminal law of the enemy, which contrasts with the basic guarantees inherent in Criminal Law.
Finally, the influence of the jurisprudence of the Inter-American Court of Human Rights is presented both in international courts, such as the European Court of Human Rights and the International Criminal Court, and in Brazilian national courts. It thus points out its potential for expansion and interference in the way in which the relationship between Criminal Law and Human Rights is understood.
This book is intended for all those who seek to deepen their knowledge of the complex relationship between Criminal Law and Human Rights, and especially to learn about the main theses developed by the Inter-American Court of Human Rights on this subject.

This book challenges the simplicity, predestination, and self-evident nature of contemporary narratives of transitional justice. Transitional justice is the field of study that examines how states should reckon with massive human rights abuses. The book upends these assumptive narratives on three crucial fronts. The first front is that of innovations. Here, the book questions the ability of transitional justice to deliver tangible successes in an era of rapid and overwhelming technological change and contestation over what constitutes human memory, communicative dialogue, and reliable evidence. The second front involves boundaries. Here the book confronts the professed superpower of transitional justice to do more and more, in an endless concatenation of additives. While there is cause for optimism, this book also suggests that transitional justice remains awkward in how it copes with the existential pressures of environmental, health, and cultural crises. On its third front, refractions, this book identifies how transitional justice addresses racism, misogyny, and democratic backsliding. How the prism of transitional justice interventions refracts these scourges remains inadequate. Throughout, the book asks readers to imagine where the field and practice of transitional justice could go from here-what new innovations are required, what boundaries must be stretched or retrenched, and what perspectives need to be considered due to new ways of seeing current and past atrocities.Accordingly, this book will be of considerable interest to academics, practitioners working on post-conflict reconstruction, and students at all levels ranging from undergraduate to post-doctoral in the areas of law, politics, cultural property, criminology, human rights, international relations, and technology studies.
