Historically the law of tort has offered limited protection for personal privacy however, since the enactment of the Human Rights Act 1998 this branch of the law of tort has seen rapid development. This book analyses the extent to which the law of tort currently affords protection against invasions of personal privacy and the remedies that are available. The book considers tort law and privacy in other common law jurisdictions including the US, Australia and New Zealand. It then goes on to explore the potential for a common law tort to be developed which would be capable of offering broader protection for personal privacy and its prospects for statutory codification.

This ambitious and important book explores the new concept of the doctor-patient relationship, told from the private law perspective. The doctor-patient relationship is different to others. Doctors are required to take positive action when dealing with patients and, accordingly, can be held liable for omissions. However, due to the strict adherence to physical injury as the dominant form of damage in negligence law, a doctor's duty of care is operating, in effect, as a duty not to negligently cause physical injury. This book identifies this to be the main barrier to protecting interests other than bodily integrity in medical negligence law. By so doing, it sets out a new duty of care framework: namely that a doctor would owe a 'positive duty to take care' of the patient's interests. This would ensure that the reasons for requiring doctors to take positive action would be carried through to the damage enquiry. Damage would either not be necessary, or would be expanded to include interests other than bodily integrity. It offers an important and ambitious new way of thinking about the doctor-patient relationship.

The second edition of the book provides a thorough legal analysis of sovereign indebtedness, examining four typologies of sovereign debt – bilateral debt, multilateral debt, syndicated debt, and bonded debt – in connection with three crucial aspects: genesis, restructuring, and litigation. Should we give up privacy to fight disease, for national security, or to help train AI systems? Recent crises, from the Covid-19 pandemic to the Russian invasion of Ukraine, from Gaza and Afghanistan to the seemingly unstoppable rise of AI, have put privacy under severe pressure. Privacy in Crisis argues the opposite: these crises show that privacy needs to be protected even more. This book explores the use of the doctrine of good faith in the common law when interpreting contracts and resolving disputes.

This doctrine is well-accepted in civil law, is reflected in international commercial law, and is a fundamental aspect of private law in the USA. However, its use in the UK is extremely limited. Inconsistent application has given rise to confusion and uncertainty. This apparent antipathy is somewhat hard to fathom, given its previous widespread acceptance in English law.


The book explains in depth the history of good faith in English law, and clarifies its current status in English, Australian and international law. It explores the relationship between good faith within contractual relations and the neighbour principle in tort law, and notes the workability of good faith in the commercial context of insurance. This will be welcomed by contract lawyers in both common law and civil law jurisdictions. A subsequent volume will explore how acceptance of good faith in the law might lead to a re-interpretation of existing contract law doctrine.

It challenges recent views that the principle renders property law inflexible and unable to accommodate social and economic changes. This innovative and thought-provoking book studies how subrogation and marshalling should be understood in the context of private law. Subrogation and marshalling are legal rules which give a person new rights with prima facie the same content as someone else's extinguished rights. There is little examination of why the law does this. This book argues that the key to understanding subrogation is the distinctive form of the rights that it creates. The form of rights created reflects a particular role in ensuring interpersonal justice: subrogation's role is to properly distribute the burden of debts.
