Modern Studies in European Law

This open access book challenges the existing focus in EU citizenship scholarship which overlooks the limitations of free movement for atypical workers. Arguing that the deliberately vague EU concept of 'work' allows for its restricted application in Member States, the book shows how many workers and economic contributors are left out of the free movement regime. It does this by taking a mixed methods approach: relying on both qualitative case studies and legal analysis of EU and UK legislation, case law, and decision maker guidance. All this leads to a significant and original argument that, if EU free movement rights are awarded on the basis of market credentials, more must be done to work towards a more contemporary, accurate and inclusive market citizenship. Provocative and thought-provoking, this book will appeal to all scholars of EU free movement law. The Market Citizenship Illusion

This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.

Despite the remarkably serious problems caused by aging and population decline in Japan, there are very few books that inform the world about them in English. Through this book, a Japanese economic demographer clearly shows the various economic consequences of population problems in Japan, especially the impacts of continuing ultra-low fertility and the world's highest life expectancy in the post-demographic transition phase. The explanation is at a basic level but covers the overall economic issues including labor, capital, technical progress, consumption, savings and investment from a demographic perspective. Finally, some remedies for economic growth in Japan are proposed. Because economic policies are expected to have short-term effects while demographic ones to increase the fertility rate need some time to take effect, earlier books about the Japanese economy have hardly ever dealt with demographic policies. Furthermore, this book directly addresses the integrated economic and demographic policies appropriate to Japan. These are different from the French natalistic social policy, the Scandinavian policy of a work-life balance or the immigration policy in Australia or the United States. This book emphasizes the power of local communities in Japan as a part of East Asia. In this sense, the book provides a new key to readers who are interested in the future Japanese economy and population.

This book offers a critical examination of the due diligence frameworks employed by select Commonwealth Island Citizenship by Investment (CBI) programs, where an investment of as little as USD $200,000 can secure a second passport, granting visa-free access to numerous countries. While these programs have positioned themselves as lucrative avenues for economic development, they have drawn sharp international criticism for their susceptibility to financial crime.The study delves into the consequences of the weaknesses in the frameworks, highlighting how inadequate regulatory oversight can erode investor trust, invite international sanctions, and jeopardise the long-term economic sustainability of CBI programs. Through a financial crime lens, it explores how these shortcomings have turned CBI programs into potentially high-risk ventures, attracting scrutiny from international regulators, law enforcement agencies, and global watchdogs, in the region and beyond.
