This open access book critically analyses a wide range of consumer law issues generated or exacerbated by the Internet of Things. The Internet of Things challenges many of the dichotomies which have shaped current laws: goods-services, hardware-software, tangible-intangible, online-offline. The book focuses on 4 specific challenges: things-as-service, liability, bricking of physical devices through software control, and the potential for enhanced personalisation, especially for digital assistants. The chapters analyse specific applications such as smart homes, connected cars, and consumer wearables with a view to providing innovative solutions to the new challenges posed by the Internet of Things, and to steer the development of the Internet of Things in a fairer direction. As well as offering an important analysis of the potential for smart consumer laws in the Internet of Things, the book also provides important insights into the growing divergence between Germany's and the UK's consumer laws since Brexit. Les petites entreprises sont essentielles au développement économique par leur contribution à l'emploi, à l'innovation et à la croissance. Cependant, leur taux d'échec précoce est élevé, un phénomène encore peu étudié, notamment en Algérie. Cette recherche cherche à comprendre les causes de l'échec des petites entreprises algériennes en proposant une typologie des entrepreneurs ayant connu l'échec ainsi qu'une grille d'analyse fondée sur l'étude des cartes cognitives.

L'étude adopte une méthodologie qualitative en quatre étapes. Une première phase exploratoire repose sur 45 entretiens non directifs menés auprès d'experts, de témoins privilégiés et d'entrepreneurs. Ensuite, 17 entretiens ciblés ont permis d'analyser en profondeur les facteurs d'échec auprès d'entrepreneurs ayant effectivement échoué. Une analyse approfondie de 9 cas a ensuite permis d'identifier les principales dimensions constitutives de l'échec entrepreneurial. Enfin, l'analyse de 7 cartes cognitives a servi à examiner les interactions complexes entre ces différents facteurs.

Les résultats montrent que l'échec entrepreneurial est un phénomène multidimensionnel résultant de l'interaction de facteurs interdépendants. Ceux-ci incluent l'instabilité de l'environnement entrepreneurial, le manque de compétences, la perte de motivation, l'influence du contexte social, certains traits de personnalité spécifiques et, en dernier lieu, l'abandon du projet entrepreneurial.
