This open access book offers an in-depth understanding of the challenges, dilemmas and strategies of reinstating the rule of law after the dismantling of a constitutional order. Drawing on the case of Poland's democratic transition back to the rule of law, the volume explores the uncharted territory of restoring independent institutions within an EU Member State. After eight years of autocratic interference with the judiciary, media and state institutions, the Parliamentary elections of October 2023 mark a turning point for Poland. The new government now faces the complex challenge of restoring the rule of law, with European and international law playing a pivotal role. Still, at numerous crossroads a dilemma comes up: Can the rule of law be disregarded to restore it? Or must the rule of law be adhered to at the risk of legal and institutional paralysis? This book presents strategies for solving this dilemma in theory and practice, thereby paving the way for other states' transitions to come. Through a comparative and interdisciplinary approach, including historical and contextual analysis, the authors show that restoring the rule of law is more than just a legal challenge. It examines the axiological foundations of participatory attitudes and their impact on civic engagement, while also presenting practical examples of their implementation and influence on local communities.
By presenting participatory models, the publication highlights various interdependencies shaping civic activity. While many forms of participation are similar or analogous, others are unique in nature. Regardless of the level of democratic development, citizens’ habits, or even the state of war, the analysis demonstrates that at the current stage of democratic development social participation can no longer be disregarded, as citizens increasingly strive for co-decision-making.

Legal and Axiological Determinants of Innovative Democratic Mechanisms in Local Communities of Central, Eastern and Southern European Countries

In this major reinterpretation of one of the greatest thinkers of the twentieth century, Geoff Goodwin draws on contemporary perspectives and issues emanating from the Global South in order to offer a new theory of the many possible paths through and beyond capitalism. A new paradigm based on quantum probability that can model stock markets and price options—and also upends classical quantitative finance. In The Quantum Stock Market, David Orrell combines theory and new empirical findings to argue for a new approach to finance based on quantum probability. The main finding, a property called q-variance, may be unique in finance in that it was discovered as the result of a prediction, affects financial markets in general, has no tunable parameter, and has important consequences for a range of topics including the pricing of financial options. The property, which somehow eluded detection for over a century, has been verified by experts in the field. And the fact that it is incompatible with classical finance—which is perhaps why it went undetected—suggests that the field must be reinvented.
