This book fills the urgent need for a comprehensive understanding of the law, institutions, and processes shaping international economic dispute settlement within and beyond Africa. African economies are becoming increasingly central in global trade networks. Understanding the continent's dispute resolution mechanisms is more crucial now than ever. The book systematically analyses the existing sub-regional courts and arbitral tribunals, as well as their roles. It achieves this by focusing on Africa's leading socio-legal actors involved in economic dispute settlement, including African States, transnational corporations, African international law scholars, international organisations, and African emerging transnational actors in arbitration. These 5 pillars create an ecology of socio-legal actors, interacting and intersecting to generate a complex social, political, historical, and legal variation matrix for understanding African international economic dispute settlement. This book studies how international law is evolving to meet the challenges of the digital age. This book tries to answer this question by presenting a detailed analysis of how international law is responding or failing to respond to the digital economy.

The author investigates how leading countries with advanced digital economic systems, including the regulation of cryptocurrencies or digital trade and E-commerce in the European Union, China, and USA, have approached these issues. Taking the WTO and the UN as examples, the book examines the efforts made by these international institutions to retrofit traditional legal structures for a world increasingly defined by the internet. Can global trade rules designed for physical goods be applied to digital products and services? How can global institutions facilitate cooperation between countries with drastically different levels of technological development? These questions shape the discussion.

The approach used in this book does not only focus on the laws but also the growing technological world. The digital world is more dynamic than it is possible to regulate it through laws that may take a lot of time to be adopted and enforced. This book provides a critical examination of the deficiencies in decent work within global supply chains. It explicitly identifies and discusses the core elements of decent work as defined by the International Labour Organisation's (ILO) decent work agenda, while underscoring the essential international human and labour rights principles that are integral to achieving these standards. The study firmly asserts that multinational enterprises (MNEs) have a pivotal role in advancing decent work initiatives. However, it is undeniable that many of these enterprises frequently fail to comply with established decent work standards. MNEs have gained stronger international influence, and they are able to move their businesses to countries with low cost of labour and less regulations. This phenomenon weakens the governments of host nations as they are keen to promote foreign direct investment in order to reduce unemployment and to ensure economic growth. As a result, the host nations are encouraged to set laws that will attract MNEs at the expense of human and core labour rights. As a result, MNEs are not held accountable in respect of alleged abuses of human and labour rights.
This book recommends regulatory reforms, which will empower the ILO to intervene to prevent human and labour rights violations by MNEs and where such violations occur, to at least provide effective remedies to vulnerable employees.

If a legal transaction results in an undesirable tax burden due to overlooked tax consequences, the question arises whether, and to what extent, these consequences can subsequently be corrected. Katharina Göpfarth examines the legal instruments for eliminating unwanted tax consequences within the conflict between private and tax law. Central to her analysis is the finding that the removal of tax consequences is achieved primarily through civil law mechanisms and that it produces ambivalent effects. On the one hand, it can offer taxpayers compensation for the lack of certainty in tax planning; on the other hand, it creates improper incentives for risk-free tax avoidance. Based on a comparative study of Germany, England, and Canada, the author demonstrates how courts incorporate tax policy considerations into the application of private law instruments and what consequences this entails for legal doctrine and legal policy.

Industrial policy, decarbonisation, de-risking of supply chains: the regulation of subsidies is at the forefront of the transformations that the world economy is undergoing. The book provides an overview of the foundations of EU State aid law, one of the most dynamic areas of EU law. An up-to-date and accessible framework explains the core conditions underpinning the notion of State aid - including advantage and selectivity. The book also covers how the EU model has changed over the past decade. It helps navigate the complex case law on the application of EU State aid law to tax rulings concluded with large multinationals (such as the Apple saga) as well as the perma-crisis of the regime since the COVID pandemic. The ways in which the EU model extends its reach beyond its borders - convergence and unilateral expansion - are also addressed. The UK Subsidy Control Act 2022 and the EU Foreign Subsidies Regulation are discussed and put in context.
