Since the Nuremberg trial, the crime of aggression has been considered one of the gravest international crimes. However, since the 1940s no defendants have been charged with this crime, with some states actively opposing the notion of punishing aggression. The option of trying an individual for aggression is expressly included in the statute of the International Criminal Court. In 2010 the Assembly of States Parties adopted a definition of the crime of aggression and conditions of the exercise of jurisdiction over this crime by the Court. The Assembly also agreed that the decision on including the crime of aggression within the Court's jurisdiction would be made in 2017 at the earliest. It is still internationally debatable whether the criminalisation of aggression is an outcome to strive for, or whether its abandonment is more preferable.

In Criminal Responsibility for the Crime of Aggression, Patrycja Grzebyk explores the scope of criminal responsibility of individuals for crimes of aggression and asks why those responsible for aggression are not brought to justice. The book first works to identify the legal norms that define and delegalise aggression, before moving to determine the basis and scope for the criminalisation of aggression. The book then goes on to identify the key risks and difficulties inherent in trials for aggression.

Following a string of awards in Poland, including the Manfred Lachs Prize for the best first book on public international law, this cutting investigation of aggression is now deservedly made available to the wider world. In its extensive analysis of international trials on aggression, and its synthesis of legal, political and historical rhetoric, this book offers broad and striking insight into the criminal responsibility of individuals on a world stage.

Increasingly, transnational corporations, developed countries and private actors are broadening the boundaries of their investments into new territories, in search of a higher return on capital. This growth in direct foreign investment involves serious concerns for both the investor and host state. Various exponents of international civil society and non-governmental organisations persuasively claim that such growth in foreign investments constitutes potential and serious hazards both to the environment and the fundamental rights and freedoms of local populations. 



This book explores from an international law perspective the complex relationship between foreign investments and common concerns, i.e. values that do not coincide, or do not necessarily coincide, with the interests of the investor and of the host state. It pays particular attention to the role of the main international development banks in reconciling the needs of foreign investors with the protection of common concerns, such as the environment, human rights and labour rights. Among its collection of essays, the volume asks how much "regulatory space" investment law leaves; whether international investment law is an effective means of balancing contrasting interests, and whether investment arbitration currently constitutes a mechanism of global governance.



In collecting the outlooks of various experts in human rights, environmental and international economic law, this book breaks new ground in exploring how attention to its legal aspects may help in navigating the relationship between foreign investment and common concerns. In doing so, the book provides valuable insights into the substantive issues and institutional aspects of international investment law.

This book offers an original analysis of private copying and determines its actual scope as an area of end-user freedom. The basis of this examination is Article 5(2)(b) of the Copyright Directive. Despite the fact that copying for private and non-commercial use is permitted by virtue of this article and the national laws that implemented it, there is no mandate that this privilege should not be technologically or contractually restricted. Because the legal nature of private copying is not settled, users may consider that they have a 'right' to private copying, whereas rightholders are in position to prohibit the exercise of this 'right'. With digital technology and the internet, this tension has become prominent: the conceptual contours of permissible private copying, namely the private and non-commercial character of the use, do not translate well, and tend to be less clear in the digital context. 

 

With the permissible limits of private copying being contested and without clarity as to the legal nature of the private coping limitation, the scope of user freedom is being challenged. Private use, however, has always remained free in copyright law. Not only is it synonymous with user autonomy via the exhaustion doctrine, but it also finds protection under privacy considerations which come into play at the stage of copyright enforcement. The author of this book argues that the rationale for a private copying limitation remains unaltered in the digital world and maintains there is nothing to prevent national judges from interpreting the legal nature of private copying as a 'sacred' privilege that can be enforced against possible restrictions.

El presente libro se centra en el debate sobre los representantes de comercio y la contratación mercantil de agentes comerciales. Aun cuando en la práctica estas dos figuras suelen confundirse, son opuestas y es necesario diferenciarlas para su aplicación en el tráfico jurídico. A través del estudio y sistematización de sentencias, en su gran mayoría del Tribunal Supremo español, se evidencian los criterios judiciales para determinar la auténtica diferenciación entre las figuras del agente y del representante de comercio, sus elementos y los efectos en las distintas relaciones jurídicas. Con la ayuda de la doctrina española, este libro precisa el concepto y la naturaleza jurídica del agente de comercio, y enfatiza en sus características más importantes: la estabilidad y la independencia. Global Challenges in the Environmental Humanities

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. Wissenschaftlicher Aufsatz aus dem Jahr 2011 im Fachbereich Jura - Europarecht, Völkerrecht, Internationales Privatrecht, Georg-August-Universität Göttingen, Sprache: Deutsch, Abstract: Im Sommer des Jahres 1988 wurden in der islamischen Republik Iran Zehntausende politische Gefangene ohne rechtstaatliches Verfahren in einer Nacht- und Nebelaktion hingerichtet. Das aktuelle iranische Regime versucht diese Ereignisse auch mehr als zwei Jahrzehnte später immer noch zu vertuschen. Derzeit gibt es Bestrebungen, ein internationales Gericht einzurichten, um den Opfern und ihren Familien Gerechtigkeit zukommen zu lassen. Dieser Aufsatz dient dazu, einen ersten Überblick über diese Verbrechen gegen die Menschlichkeit zu erlangen und ist zugleich ein Plädoyer für weitere internationale Bemühungen: Die juristische Aufarbeitung des Massenmords an politischen Gefangenen im Iran im Jahre 1988 steht noch immer am Anfang und bedarf weiterer internationaler Unterstützung, da ansonsten die Gefahr besteht, dass der Gerechtigkeit niemals Genüge getan werden würde.

Document from the year 2002 in the subject Law - Comparative Legal Systems, Comparative Law, grade: keine, , course: Internship with the International UN Criminal Tribunal for Rwanda, language: English, abstract: I was on my way to a small village in the outskirts of down-town Kigali, where a traditional “Gacaca trial”, which has been introduced in every small conglomeration of the country, was taking place that day, in an attempt to deal with the almost 120.000 people who are still being held in prison in the aftermath of the genocide (at 2002). About a hundred meters down the road there was an open meadow on which a big, burned remains of a house was standing. In the courtyard of this house there were chairs, benches, tables as well as a big plan of the UN Refugee Organisation (UNHCR) that was providing a shade. At this time only a group of elderly men who made up part of the 19 traditional judges had arrived at the scene. I followed the three hour process itself with the help of a translator and friend, Emmanuel, a young Rwandan journalist. As the approximately 250 village inhabitants were taking leave at the end of the session, I was also thinking of parting, but at this moment one of the traditional judges, a rather friendly, tall and lean gentleman of about 45, came over to me. We took seats alone, as he spoke very good English and we did not need a translator, on a nearby bench a bit removed from the villagers who were still standing all around the place. In the meantime Emmanuel had caught company of an old friend, with whom he stood around the dilapidating door frames, just a stone throw away from us.
