Intersecting Police Liability with Neurobiology

This interdisciplinary collection illuminates the religious roots of marriage and divorce in Europe and their divergent history from the 18th century to the present day. The 18th century was a pivotal period in terms of how the rules governing marriage and divorce were determined, with authority to set and adjudicate on rules shifting from religious authorities to the state. This book evaluates these historical developments, paying particular attention to the waxing or waning influence of religious institutions, values, or norms and whether further suggestions for reform have been made. Volume 1 of A History of Family Law in Europe examines how, and the extent to which, marriage formation and dissolution are regulated in the written texts of the Catholic, Protestant, and Orthodox traditions. The contributors analyse the respective traditions' teachings on marriage formation, marital impediments, and dissolubility, including these traditions' views as to the socially binding character of these teachings. Jurisdiction-specific chapters focusing on countries across Northern, Central, Southern, and Eastern Europe examine the regulation of marriage formation and dissolution in the context of religious and other cultural influences. This book brings together the insights of an international team of leading marriage-law scholars across Europe, and will be a significant resource for scholars of family law, legal history, and the history of religion.

A History of Family Law in Europe, Volume 1

This volume explores the various intellectual property dynamics that emerged during the Cold War, circa 1946-1980. This period brought about some of the most poignant moments in the development of twentieth-century international intellectual property rights, when competing economic systems recognised the value in innovation, human creativity, cinema, and international intellectual property norms and institutions. Examining these developments from a Cold War approach can say much more as it allows for the examination of processes and norms that cater to strong domestic intellectual property rules in Western capitalism while yielding to 'universal' or 'common' property norms in copyright in socialist states. This volume connects some of the different advances made in the international emergence of these competing developments regarding intellectual property rights and emphasises the role of intellectual property institutions, processes, and universalism that helped keep Cold War rivals on the same normative, foundational street for intellectual property rights. The work presents a legal biography of the former Federal Constitutional Court justice Ernst Friesenhahn, offering for the first time a comprehensive assessment of his life and work. To this end, the study evaluates, among other sources, Friesenhahn's papers held in the Federal Archives in Koblenz as well as case files of the Federal Constitutional Court relating to proceedings in which Friesenhahn participated during his tenure from 1951 to 1963. This reveals the portrait of a constitutional lawyer who - having earned his doctorate under Carl Schmitt in 1928 and later breaking with him - emerged from the National Socialist period largely unscathed as a devout Catholic. Friesenhahn belongs to those figures who exerted considerable influence on the development of German constitutional law scholarship in the postwar era - especially in the field of constitutional procedural law - and who helped ensure that the prominent goal of establishing a rule-of-law state, as enshrined in the Basic Law, did not remain an empty promise. He advocated a form of legal positivism that was neither sterile nor ahistorical, but consistently oriented toward reality and practical life. At the Federal Constitutional Court, in his role as a "professor-judge," he ensured that the judgments of the Second Senate were coherent and rigorously reasoned. He played a key role in major cases of the Adenauer era, such as those concerning the European Defence Community Treaty, the Reich Concordat, and the "Deutschland-Fernsehen" case. As President of the German Jurists' Conference (1962-1966) and as Chairman of the Association of German Constitutional Law Teachers (1968 and 1969), he shaped constitutional law debates in the Federal Republic and, drawing on his own life experiences, credibly advocated for confronting the injustices of the National Socialist regime. As a co-founder of the Institute for Church-State Law of the Dioceses of Germany, he earned lasting merit in this field of law.

This is a study of elite English men of English law and the methods they used to retain and justify their power and privilege, through controlling the story of the legal person. It looks at how these men of legal authority thought of themselves and their institution; how they studied and explained law; and how they put themselves in the middle of it, as the standard human in need of legal regulation and protection and in charge of that regulation and protection, and assigned to women an inferior legal role and being. The main strategy used to do all this was manipulation of the concept of 'the legal person'. From the 1860s to the 1920s the courts declared that women were not 'persons' who could exercise public power - to vote, to sit in Parliament, to gain degrees, to be lawyers. Up to the end of the 20th century, and into the 21st, women's personhood remained precarious in the private sphere, for rape was excused within a marriage and female reproduction remained under state control (as it still does). The book examines the active exclusion of women from the means of making legal meaning, especially the ability to shape law's central concept and shows the epistemological effects of this sex differential of legal power which are still felt today. Leading legal thinkers who helped to masculinise the concept of the person, to the detriment of women, are still revered. Law's continuing male orientation is neither seen nor acknowledged and the legal person is treated (falsely) as if he had always been and remains anyone.

This book offers the first detailed study of women's legal status in early modern Liège, an otherwise largely overlooked case in European legal history. It follows women across the course of their lives, from birth to widowhood, to show how their legal position and control over property shifted over time, depending on their social status and place within the family. Drawing on a substantial body of wills and marriage contracts from notarial practice, it moves beyond traditional sources to show how the law actually worked in everyday practice, and who took part in its creation. By bringing all these elements together, this book offers a nuanced picture of how law and gender interacted in early modern Europe.

The first history of US federal law enforcement from the nation's founding to the creation of the Justice Department in 1870, showing how federal prosecutions have always been shaped by local institutions and interests. The public imagines the Department of Justice and its agencies as mighty juggernauts. The reality is strikingly different. The FBI is barely larger than the Chicago Police Department, federal courts handle far fewer cases than state courts do, and federal prosecutors rely heavily on state and municipal authorities. The feds cannot function without local support, which means that the projects on which DOJ intervention is most needed-the ones that local communities oppose or don't care about-are also those least likely to succeed. This is no accident. Fragile Authority shows that this weakness is built into the structure of federal enforcement. To understand why, Daniel Richman traces the present-day workings of the DOJ all the way back to the nation's founding. The system was so circumscribed at the start that districts went years without a single conviction; enforcement efforts were often just performances of sovereignty for foreign audiences. And while a stronger enforcement apparatus emerged from the 1850 Fugitive Slave Act, its protection of Black civil rights during Reconstruction lasted only a few years before the federal retreat. After its creation in 1870, the Justice Department concealed its limitations by turning the agendas of local police-such as prosecuting gangsters, car thefts, and prostitution-into ostensibly national priorities. For better and for worse, federal law enforcement missions without local buy-in remain rare and difficult to sustain. The resistance to President Trump's immigration enforcement surge in sanctuary jurisdictions showed yet again that this norm is not easily broken.

This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art.
