WHAT, WHY AND HOW?

Examines whether the rule of law can endure without its natural law and metaphysical foundations, arguing for a renewed, human-centered legal order grounded in objective moral principles and capable of addressing contemporary challenges such as AI, technocracy, and decolonization.
This provocative interdisciplinary volume addresses a mounting global crisis: the erosion of the rule of law in an increasingly secular and technological world. As societies move into what the authors call the "fourth era" of legal history, the rule of law is frequently reduced to a mere "toolkit" for elites or a "checklist" for bureaucratic efficiency, stripped of its deeper moral and transcendent roots. The book explores a vital question: can legal systems remain just when they are "truncated of transcendence" and disconnected from a higher moral order? By sifting through the legacies of legal giants like Lon Fuller and theologians like Karl Barth, the contributors argue that a purely procedural "inner morality" is insufficient to protect human dignity against authoritarian relapses or the cold logic of "technocratisation." 
Central to the book's unique vision is a multivalent, pluralistic re-envisioning of global norms. Drawing on the Christian philosophy of Herman Dooyeweerd, specifically his concept of "sphere sovereignty," the authors propose a framework where diverse religious and secular traditions can collaborate without sacrificing their distinct identities. This approach offers a powerful way to decolonize the rule of law, moving away from "one-size-fits-all" Western impositions toward a culturally sensitive synthesis of universal principles and local traditions. 
The text also tackles the controversial relationship between Natural Law and the 10 Commandments, debating whether positive laws should be grounded in "naturally knowable" truths or specific religious revelations in a pluralistic state. 
Looking toward the future, the authors issue a stark warning against the rise of Generative AI (GenAI) in legal adjudication. They argue that replacing human value judgments with machine-driven algorithms threatens to eliminate the discretion and relational interaction essential to true justice. To counter this, the book calls for educational reform and a shift toward "principled legal education" that prioritizes ethics, restorative justice, and a "facts first" approach. Ultimately, this work is a call to action for legal professionals, theologians, and the public to reclaim law as a framework for human flourishing-a "language of love" between the divine and the human that protects the vulnerable from the arbitrary exercise of power.

This open access book tells the story of how a standing board of judges in London has shaped the constitutional laws of Commonwealth countries through its most consequential decisions since 1833. It provides a broad-ranging critical analysis of the Judicial Committee of the Privy Council's (JCPC) constitutional influence and legacy to date as the oldest serving multinational supreme court in the world. From over 193 years of case law, 17 decisions are identified and represent, for better or worse, defining historical and constitutional moments in their respective jurisdictions and beyond. They originate from 11 countries on 5 continents, reflecting the once worldwide breadth of the JCPC's authority. Several cases from the Global South, which have tended to be overlooked in the Western literature and case law, are included. From a criminal law perspective, the book offers a dual-level critique. On the one hand, criminal law is invoked for its expressive and symbolic function, particularly in response to the discriminatory and gender-based harms often associated with deepfakes, as well as the broader need to prevent systemic risks to democratic society when it comes to electoral manipulation and freedom of thought. Here, criminal law would play a vital role in affirming societal condemnation of such conduct and in acknowledging the serious impact on victims. On the other hand, its use is increasingly entangled with emerging frameworks of digital regulation, taking on a more instrumental role in defining illegal content and reinforcing standards shaped primarily by private platforms and regulatory bodies. Kamal Shair's book is a classic rags to riches story: the village boy, who with determination and education, achieves business success, wealth, more wealth, and then influence and power. What makes it unusual is that it emanates from the Arab world. Rarely among Arabs have individuals from thoroughly modest backgrounds, with no access to links, networks or connections become truly global commercial players. Shair was born in a small town in what was then Transjordan and dragged himself through school (his mother was illiterate), moved to college in Beirut, then sailed off to America (Michigan and Yale) and returned to the Middle East to create a multinational corporate empire engaged in trade, construction and manufacturing. Dar al Handasah - Arabic for House of Engineers - was founded in a small flat in Beirut and today, spans the globe with offices in 37 countries. In its early years, Dar al Handasah fought off competition from established western consultancies to win contracts for prestige engineering throughout the Middle East. Eventually, its activities extended further to Europe, the United States, Africa and Asia. By not following the usual pattern of patronage and favours, Kamal Shair applied a fresh kind of ethic in an environment with a loosely-structured business ethic. In the process, he lived through and witnessed at first hand and at close quarters some of the most dramatic events of the modern Arab world. This is quite an extraordinary tale and a very original prism through which to read the turbulent post-World War II history of the Middle East. At the same time we see the growth, despite all the odds, of one of the world's great engineering and business enterprises in a narrative of epic and inspirational proportions.

In Shock and Yawn, Megan Sibbett confronts state-sanctioned, mundane violence committed in the name of protection and argues that queer storytelling is an ideal avenue for recognizing, theorizing, and subverting it: Through queer stories, we have a direct window into the real-world ramifications of violence that purports to be for the public good. This violence, reinforced and normalized through surveillance campaigns, failure-to-protect laws, border policies, and government messaging, is obscured by both its banality and its benevolent veneer, in which children, or imagined children, are central to its logic of protection.
 
 Building on queer theorists' critiques of intimate and administrative violence, especially Gloria Anzaldúa's "intimate terrorism," Sibbett develops methodologies for conceptualizing and subverting violence aimed at queer, racialized, and gendered bodies in this era of surveillance and increasing authoritarianism. Sibbett addresses book bans, anti-trans legislation, idealized histories of westward expansion, and more, examining materials that include public service announcements, advertising, social media, news reports, poems, interviews, and novels. In so doing, she demonstrates the crucial role queer testimonies-and queer histories and queer futures-play in revealing systemic violence and illuminating the transformative potential of everyday resistance.
