A guidebook to the institutional transformation of design theory and practice by restoring the long-excluded cultures of Indigenous, Black, and People of Color communities. From the excesses of world expositions to myths of better living through technology, modernist design, in its European-based guises, has excluded and oppressed the very people whose lands and lives it reshaped. Decolonizing Design first asks how modernist design has encompassed and advanced the harmful project of colonization—then shows how design might address these harms by recentering its theory and practice in global Indigenous cultures and histories. A leading figure in the movement to decolonize design, Dori Tunstall uses hard-hitting real-life examples and case studies drawn from over fifteen years of working to transform institutions to better reflect the lived experiences of Indigenous, Black, and People of Color communities. This book develops and applies the theory of lethal moralism to explain the different types and growth of terrorism over the last half-century, from 1970 to 2020.Drawing on data from the Global Terrorism Database, supplemented with original research differentiating groups based on their ideological orientations, it delves into the social and cultural forces that influence those who engage in terrorism, including the dynamic processes of "othering" that produce the social polarization crucial for understanding why some groups resort to lethal violence to handle their grievances. Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. In this book, John Finnis provides a virtually unparalleled, in-depth assessment of Leon Petrażycki’s work by a Western scholar. In the opening chapter, Finnis takes up the challenge of reading Petrażycki not simply as a historical curiosity of Eastern European jurisprudence but as a thinker whose wide-ranging and ambitious ideas continue to spark debate today. He critiques not only Petrażycki’s non-standard “economic analysis of law,” which differs markedly from the Chicago School model (not to mention from Guido Calabresi’s and Pietro Trimarchi’s versions), but also many other aspects of Petrażycki’s various contributions to jurisprudence. These include, above all, his legal-realistic but nonetheless appreciative treatment of the natural-law tradition(s), which makes Petrażycki both distinctive and difficult to classify in terms of standard schools of thought.Finnis’ essay is followed by nine further contributions. Written by scholars from different traditions and standpoints, they criticize, reassess, and elaborate upon Finnis’ arguments, creating a rich and multi-voiced dialogue. This book makes a new and original contribution to the old debate about differences between socio-economic and civil and political rights, which has engaged human rights discourse over several decades. Although scholars and practitioners now agree that these categories are more alike than originally assumed, they continue to delineate them based on the alleged difference between immediate and progressive realisation. The book asks whether this differentiation is still valid by exploring the historical and theoretical background, the text of relevant UN human rights treaties, and the practice of the UN human rights committees.
