Multilateral environmental agreements have over the last four decades emerged as the preferred avenue to address inter-state environmental issues such as climate change. This book analyses the possibilities as well as the limitations of environmental treaty making between states. The book considers the structures and processes that lead to the successful adoption of the Paris Agreement - and contrasting them with other attempts that failed in bringing states together under a legally-binding solution. Christina Voigt explores the whole "life-cycle" of multilateral environmental agreements. Also emphasised is the impact of emerging economies in shaping international environmental regimes.

Environmental Multilateralism and its Discontents

Krankenkassen und Pflegekassen sind die nationalen Träger der gesetzlichen Krankenversicherung bzw. der sozialen Pflegeversicherung. Schauen sie zum einen auf eine lange Tradition zurück, sehen sich deutlich wandelnden Anforderungen im Hinblick auf das das Management der Trägerstrukturen gegenübergestellt.
 
 Zu den Hauptaufgaben der Kranken- und Pflegekassen gehören die Organisation der Versorgung im Falle von Krankheit, Mutterschaft, zum Teil Unfall und Pflegebedürftigkeit nebst der entsprechenden Finanzierung und späteren Kostenübernahme sowie die Führung und Gestaltung der Verhandlungsprozesse mit den Leistungserbringern. Als Körperschaften des öffentlichen Rechts gelten besondere – insbesondere gesetzliche und damit regulatorische – Anforderungen für diese Träger. Die Einführung des freien Kassenwahlrechts Mitte der 1990er-Jahre und die Etablierung des Gesundheitsfonds 2009 hat zu einem Verdrängungswettbewerb geführt, der sich in einer Reduzierung der Anzahl der Krankenkassen manifestiert hat: Knapp 100 Krankenkassen versuchen derzeit die Versorgung für rund 72 Mio. Versicherte zu organisieren. Die Anforderungen an das Management dieser Einheiten sind damit deutlich gestiegen und zudem fallen weitere neue Aufgaben auf die Krankenkassen und Pflegekassen zu. Damit erstrecken sich die Aktivitäten der Kranken- und Pflegekassen unmittelbar auf zwei der insgesamt drei Gesundheitsmärkte: Versicherungsmarkt, Markt der Versorgungsverträge und zu guter Letzt der Leistungsmarkt.
 
 Dieses Handbuch – das erste zu diesem Thema – liefert eine hilfreiche Übersicht über die Organisation, das Versorgungsgeschehen und die Struktur der Kranken- und Pflegekassen. In den von Branchenexperten verfassten Beiträgen werden Verwaltungswissen, betriebswirtschaftliche Kompetenzen und regulatorische Grundlagen vermittelt, um sich in diesem sehr speziellen Markt behaupten zu können.

Vorherige berufliche Stationen waren dabei unter anderem das Bundesministerium für Gesundheit, das Bundesministerium für Arbeit und Sozialordnung sowie der AOK Bundesverband.

 ist Vertragsreferentin bei der Knappschaft und Dozentin in verschiedenen gesundheitsbezogenen Studiengängen. Zuvor arbeitete sie in einem auf die Gesundheitsbranche ausgerichteten Beratungsunternehmen, bei einer obersten Landesgesundheitsbehörde sowie in leitender Tätigkeit für eine Berufsfachschule der Gesundheitsberufe.

This book presents a new perspective on the debate around legitimacy, politics and constitutional law in Supreme Courts. Moving away from the troubling perception that Supreme Courts are trampling on the wrong side of the law/politics divide, it accepts and defends the critical claim that constitutional law is intrinsically and inescapably politics: in style, substance and outcome. It explains what is involved in that claim and recommends a more nuanced and compelling account than it is caricatured to be. The book proceeds to demonstrate how the legal and judicial process can proceed if the law-is-politics critique is taken seriously. Insisting that it cannot be business as usual, the author offers a series of constructive proposals about how constitutional law and judicial decision-making can continue in anything like their present format and style. Recognising that a more radical approach could be taken to the way in which democracy might re-organise, the book runs with the idea that it is possible to incorporate and accommodate the law-is-politics argument within a governmental system of constitutional democracy that resembles closely what now occurs. In that sense, the book is both critical and constructive as well as principled and pragmatic.

Rethinking Legitimacy

The university is a foundational institution in society and a cornerstone of democracy. However, recent actions taken by the Trump administration pose an existential threat to this institution by undermining its singular animating right: academic freedom. In Academic Freedom in the Era of Trump, preeminent thinkers draw from their experience as university leaders and First Amendment scholars to portray this troubling moment for academic freedom. The volume examines the legal, historical, and philosophical foundations of academic freedom, its First Amendment roots, and the implications of recent political interference. The Supreme Court has now enshrined the principle of academic freedom within our First Amendment jurisprudence, unceasingly affirming the principle while continuing to refine its contours. Yet, the Trump administration has employed an authoritarian playbook to assault this principle, withholding federal research funding and exploiting antidiscrimination laws, among other tactics. To prevail in this moment, universities must defend academic freedom by clarifying and reaffirming the constitutional origins, emphasizing the indispensable societal role, and refining and articulating the distinct culture and structures of universities that allow the principle to flourish.
