From Outlaws to Equal Players - Rebel Courts in International Law

2.000 Partisanen nehmen im Oktober 1944 die Stadt Alba im Piemont ein. Aufgrund fehlender Unterstützung durch die Alliierten müssen sie schon 23 Tage später einer faschistischen Übermacht nachgeben. Einer der antifaschistischen Kämpfer war Beppe Fenoglio. Wenige Jahre später veröffentlichte er diesen Erzählungsband, in dem er seine Erfahrungen in der Resistenza verarbeitete.
Es sind nüchterne, ernüchterte, nur gelegentlich episch-burleske Geschichten vom Kampf der politisch oft uneinigen Partisanen gegen Mussolini-Anhänger und deutsche Besatzungstruppen. Die zweite Hälfte des Bandes erzählt vom bäuerlichen Leben im 'sogenannten Frieden', von der Nachkriegsverlorenheit und der Hoffnung auf einen Neuanfang in Fenoglios Herkunftslandschaft, den Langhe im Piemont.
Die Erstübersetzung der meisten dieser Geschichten wird ergänzt um ein Nachwort und einen Kommentar zum historischen Kontext. Die Herausgeber und Übersetzer legen bei der ersten vollständigen, im Kollektiv entstandenen Übertragung von Fenoglios Debüt besonderen Wert auf die stilistischen Eigenheiten des Originals. Fenoglio wollte die Sprache der piemontesischen Bauern und Partisanen möglichst präzise abbilden und nutzte dafür ein leicht verfremdetes, literarisches Alltagsitalienisch.

Die vorliegende Studie vollzieht das Scheitern des liberalen Freiheitsversprechens anhand der zeitgenössischen deutschen Rechtskritik nach. Dabei ist der Urteilsbegriff zentral für eine Kritik des Rechts, stellt doch jeder Gebrauch eines Rechts immer auch ein Urteil dar. Die Form liberaler Urteile ist die Legalität. Diese Legalität wird als ironische Urteilspraktik kritisch rekonstruiert, welche die Subjekte nicht zu befreien vermag. Denn das lustvolle Disponieren des ironischen Urteils erzeugt keine Praxis, sondern bloß eine schlechte Unendlichkeit. Um das Freiheitsversprechen der Moderne zu retten, bedarf es daher einer Überschreitung der Ironie, welche in dieser Studie als Ironisierung der Ironie konzeptualisiert wird.

But international criminal justice is also the product of intellectual developments made in its infancy. This book examines the contributions of a dozen key figures in the early phase of international criminal justice, focusing principally on the inter-war years up to Nuremberg. Where did these figures come from, what did they have in common, and what is left of their legacy? What did they leave out? How was international criminal justice framed by the concerns of their epoch and what intuitions have passed the test of time? Sexual violence in conflict, often referred to as conflict-related sexual violence (CRSV), refers to some form of sexual and/or reproductive violence perpetrated against women, men, girls and boys that is directly or indirectly related to the conflict. This includes rape, sexual slavery, forced prostitution, forced pregnancy, forced abortion, enforced sterilisation, forced marriage, and any other form of sexual violence of comparable gravity. The perpetrators of CRSV vary between each case and include state and non-state armed groups, including terrorist organisations. This book examines some of the recent manifestations of sexual violence as atrocity crimes, and especially, prohibited acts to bring about genocide, the responses to these crimes, and issues that continue to be neglected, including in relation to the duty to prevent. The work structures the discussion around the prevalence of CRSV, its use as a tool of genocide, and other international crimes, and the failures of legal and institutional responses. By combining thematic chapters on international law and accountability with case studies, the study provides a balance between theoretical critique and empirical analysis. It further engages with the debates on what is needed to bring about change, looking at specific policy and law reforms. The work also examines the way forward, including recommendations to introduce an international convention specifically focused on CRSV, and a permanent mechanism on CRSV. Scientific advances in the biological and chemical sciences can offer significant benefits to humanity, but these discoveries may also lead to the proliferation of novel classes of weapons and new uses for them. This book explores the current challenges, risks, and opportunities posed by new scientific discoveries in this area. Focusing on non-human consequences of the use of chemical and biological weapons, issues discussed include their environmental impact; the use of herbicides in armed conflicts; the dangers presented by the transport of chemical and biological agents; the impact of technology on the development and/or manufacture of chemical and biological agents; and the various implementation efforts at national level across countries and regions.
