From Outlaws to Equal Players - Rebel Courts in International Law

Cambridge Studies in Law and Society

Grounded in legal ethnomethodology, this book explores terrorism trials in France. Drawing on extensive court ethnography, a multidisciplinary research team examines how terrorism logics are reflected, represented, and negotiated within criminal proceedings. Based on hundreds of hearing days - ranging from small terrorism criminal cases to the so-called trials for history, commonly known as the 'Charlie Hebdo' and the 'Bataclan' trials - this study offers a nuanced, bottom-up perspective on the role of courts. Through courtroom immersion, close observation of legal performances, and interviews with judicial actors, it investigates how justice is shaped in practice. Identifying three generations of trials, the book provides original insights into the evolving role of courts in terrorism cases. From an empirical and comparative perspective, it also seeks to make criminal trials more accessible to Anglophone readers, offering a deeper understanding of how terrorism is prosecuted in France, highlighting the role of judges, prosecutors, lawyers and victims.

The discourse, scholarship, and practice of transitional justice have become pivotal to addressing historical systematic injustices. However, until recently, the field has largely overlooked some of the most enduring and pervasive injustices of human history: racism and the colonialism and slave-trade that both reflected and fuelled it. Race and Transitional Justice examines how race and racism interact with transitional justice mechanisms and institutions to question why this is the case, and how it could be different. Bringing together diverse perspectives to examine the historical and socio-political contexts of transitional justice, this book argues that the field remains largely inattentive to the role of race. As a result, transitional justice institutions may be sustaining the very racialization that they are expected to remedy. The contributions offer a range of responses. Some call to abandon the whole field, citing its complicity in the indefinite maintenance of settler hegemony. Others consider transitional justice an essential space to work towards a more just, non-racist, social order. The result is a sensitive reflection into emancipatory transitional justice futures.

International Politics and the Russo-Ukrainian War

Sexual violence in conflict, often referred to as conflict-related sexual violence (CRSV), refers to some form of sexual and/or reproductive violence perpetrated against women, men, girls and boys that is directly or indirectly related to the conflict. This includes rape, sexual slavery, forced prostitution, forced pregnancy, forced abortion, enforced sterilisation, forced marriage, and any other form of sexual violence of comparable gravity. The perpetrators of CRSV vary between each case and include state and non-state armed groups, including terrorist organisations. This book examines some of the recent manifestations of sexual violence as atrocity crimes, and especially, prohibited acts to bring about genocide, the responses to these crimes, and issues that continue to be neglected, including in relation to the duty to prevent. The work structures the discussion around the prevalence of CRSV, its use as a tool of genocide, and other international crimes, and the failures of legal and institutional responses. By combining thematic chapters on international law and accountability with case studies, the study provides a balance between theoretical critique and empirical analysis. It further engages with the debates on what is needed to bring about change, looking at specific policy and law reforms. The work also examines the way forward, including recommendations to introduce an international convention specifically focused on CRSV, and a permanent mechanism on CRSV.
