Europeanisation of Access to Justice in Environmental Matters

Enhanced Cooperation Revisited offers a detailed and thought-provoking examination of one of the EU’s most discussed yet rarely applied tools for differentiated integration. Situated between supranational ambition and national sovereignty, enhanced cooperation allows groups of Member States to adopt EU law among them when unanimity proves to be out of reach —without changing the Treaties or creating opt-outs. The book explores enhanced cooperation as a legal and political mechanism that enables integration through flexibility. Departing from a thorough, yet innovative legal analysis and incorporating interdisciplinary insights, the study presents a fresh typology of enhanced cooperation uses, proposes innovative interpretations of its legal framework, and explores options like fast-track procedures and conditional participation, as well as a field-map of legal areas suitable for enhanced cooperation. A novel proposal for “incentivised cooperation” suggests a targeted Treaty amendment to make the mechanism more promising as a facilitating tool in the most contested policy areas. This open access book adds a new dimension to the long-standing research on the co-existence of European Court of Human Rights and the Court of Justice of the EU, and their inter-related action and explicit interaction. As the two Courts are increasingly called upon to interpret corresponding rights, particularly owing to the ever-growing importance of fundamental rights in the EU legal order, the stakes intensify. Prior studies have mostly focused on the constitutional and substantive issues connected to this interaction. This book focuses on another dimension: the lesser-told yet fascinating tale of two - increasingly substantively overlapping - European-level judicial systems with their own procedures and institutional idiosyncrasies, their own terminology, and with their own epistemic communities of practitioners and scholars, and their own relationship to national law. In this collection a team of experts - academics and practitioners - from both systems bridges the gap between these two worlds of fundamental and human rights protection, investigating their commonalities and differences. Activating Human and Fundamental Rights Before the European Courts

Die europäische Sicherheitsarchitektur steht vor historischen Herausforderungen. Geopolitische Verschiebungen wie der russische Angriffskrieg gegen die Ukraine, die Eskalation im Nahen Osten sowie die zunehmende strategische Nähe zwischen China und Russland destabilisieren bestehende Bündnisse und werfen Fragen über die zukünftige Rolle Europas im globalen Sicherheitsgefüge auf. Innerhalb dieser dynamischen Lage kommt der deutsch-französischen Partnerschaft eine besondere Bedeutung zu. Die enge Kooperation zwischen Deutschland und Frankreich auf politischer, operativer und industrieller Ebene hat in der Vergangenheit entscheidend zur Entwicklung und Stärkung der europäischen Sicherheits- und Verteidigungspolitik beigetragen und wird auch in Zukunft eine zentrale Rolle bei der Sicherstellung der europäischen Verteidigungsfähigkeit spielen.Dieses Buchprojekt analysiert, wie Deutschland und Frankreich gemeinsam die europäische Sicherheitsarchitektur gestalten, welche Herausforderungen dabei bewältigt werden müssen und welche Chancen eine intensivierte Zusammenarbeit bietet. Neben einer historischen Rückschau, die die wichtigsten Meilensteine der deutsch-französischen Sicherheitskooperation seit dem Élysée-Vertrag von 1963 nachzeichnet, werden aktuelle Entwicklungen wie die European Union Global Strategy (2016) und der Vertrag von Aachen (2019) sowie die Reaktionen auf den Krieg in der Ukraine analysiert. Since the end of the Second World War, restitution in Germany - Wiedergutmachung - has been mainly understood as part of state or private law. This book offers a different approach, arguing that authors and artists have also taken up a responsibility for restitution. Deploying the literal translation 'making-good-again', this book focuses on the 'making' of law, literature and visual art to argue that restitution is a practice which is found in different genres, sites and temporalities. The practices of restitution identified are dynamic, iterative and incomplete: they are practices of failure. Nevertheless, in this book, the question of how to conduct restitution emerges as a material question of responsibility asked through the making of texts and objects in different genres, including law. The resulting text is a unique expansion and re-conceptualisation of the practices of jurisprudence, restitution and responsibility in the context of the aftermath in Germany.
