Masterarbeit aus dem Jahr 2025 im Fachbereich Jura - Zivilrecht / BGB AT / Schuldrecht / Sachenrecht, Note: 1,3, Hochschule Darmstadt, Sprache: Deutsch, Abstract: Die vorliegende juristische Masterarbeit befasst sich mit der Fragestellung, ob eine Haftung von KI-Robotern national wie international gegeben ist. Dabei wird insbesondere analysiert, welche rechtlichen und praktischen Aspekte bei der Nutzung eines solchen Roboters zu berücksichtigen sind. 

Im Rahmen der juristischen Ausarbeitung erfolgt hierzu ein Rechtsvergleich zwischen Deutschland und den USA, wobei der Fokus auf dem Bundesstaat Kalifornien liegt. Die Arbeit beginnt mit einer technischen Einführung in KI und Robotik. Anschließend wird das eigenständige Handeln von KI-Robotern sowie die Frage ihrer Rechtspersönlichkeit analysiert. Darauf aufbauend werden haftungsrechtliche Herausforderungen de lege lata untersucht, einschließlich vertrags-, delikts- und produkthaftungsrechtlicher Aspekte. Abschließend werden mögliche Lösungen erörtert und ein Fazit gezogen.

Die Entwicklung und Nutzung intelligenter Systeme werfen auch Fragen in Bezug auf die Risiken und Verantwortlichkeiten auf. Sie können unter Umständen Schäden verursachen und auch gegen Rechtsnormen verstoßen, sei es ein Pflegeroboter, der die Patienten suboptimal pflegt oder ein selbstfahrendes Auto, das einen Unfall verursacht. Die Frage, ob die Nutzung von KI-Robotern als gefährlich angesehen wird, ist Gegenstand kontroverser Debatten. Eine von der KOM durchgeführte Studie beleuchtet, dass ein spezifisches Hindernis, das von Unternehmen hinsichtlich der Nutzung von KI wahrgenommen wird, die Haftung für durch KI verursachte Schäden ist.

This book revisits one of the defining judicial engagements in English legal history.
 
It provides a fresh account of the years 1606 to 1616 which witnessed a series of increasingly volatile confrontations between, on the one side, King James I and his Attorney-General, Sir Francis Bacon, and on the other, Sir Edward Coke, successively Chief Justice of Common Pleas and Lord Chief Justice.
 
At the heart of the dispute were differing opinions regarding the nature of kingship and the reach of prerogative in reformation England. Appreciating the longer context, in the summer of 1616 King James appealed for a reformation of law and constitution to complement the reformation of his Church.
 
Later historians would discern in these debates the seeding of a century of revolution, followed by another four centuries of reform. This book ventures the further thought that the arguments which echoed around Westminster Hall in the first years of the seventeenth century have lost little of their resonance half a millennium on. Breaks with Rome are little easier to 'get done', the margins of executive governance little easier to draw.

This book discusses the dominant corrective justice and distributive justice approaches to private law and identifies their strengths and weaknesses. It goes on to propose a general approach to private law, including contract, tort and private property, and explains how it can provide solutions to some longstanding problems.


 Two general ideas inform this approach: the 'standpoint limitation' and 'remedial consistency'. The standpoint limitation explains the distinctive character of private law, that is to say why it is focussed mainly, though not exclusively, on particular individual interests rather than the common welfare. Remedial consistency explains the way in which remedies depend on and give effect to primary rights.


 The book also discusses the nature of common law legal reasoning and its relationship to the suggested understanding of private law.

Justice in Private Law

This open access book presents the first comparative study on the legal sources of administrative law. Every modern legal order needs a set of general rules to apply and enforce administrative law; the rules impose principles of action, of procedure, and of organisation of the authorities. The legal basis of these rules may be quite diverse. Some countries have tried to codify administrative law, whilst others work with few rules or unwritten rules. The book considers the consequences that arise from the different degrees of codification of general administrative law. It presents answers to important questions including: Does codification increase predictability and legal certainty? Does codification lead to a 'petrification' of administrative law? To what degree does the constitution shape administrative law? Which areas of administrative law are suitable for codification, which are not, and why not?
