Einheitliches Unternehmerrecht

Carmen Freyler's study deals with the relationship between the law of commercial transactions based on the concept of a merchant and the law of contractual obligations, which is linked to the concept of an entrepreneur. The uniformity is not a finding, but the aim of the investigation. Neither the conditions of application nor the statutory system indicate a harmonisation of the two relevant regulatory complexes of entrepreneurial business transactions. Conflicts of norms and contradictions in judgement arise, particularly with regard to consumer protection law.
