In this book, leading commentators explore the new concept of 'crisis governance constitutionalism' in order to better understand how the EU is changed by times of crisis management. The contributors analyse the dynamic interplay between democracy and law within a Japanese-German comparative framework. Emphasis is placed on the democratic legitimacy of legislation as a prerequisite for societal acceptance and on the role of enacted norms in shaping administrative and judicial practice. The volume examines the structure of the democratic principle, the interaction of public law and private law mechanisms, and their combined relevance for modern democratic systems.
 

 Historical developments, legal-philosophical perspectives, and theoretical foundations are discussed, showing how Germany and Japan, despite distinct cultural and institutional traditions, have incorporated elements of the Anglo-American legal sphere. The symposium builds on earlier joint research initiatives and extends the analysis of legal governance in selected fields of law. Particular attention is given to the comparatively unexplored significance of procedural norm implementation for the functioning of democratic orders. Further chapters address economic, labour, and social regulatory frameworks, the tension between market freedom and social responsibility, and emerging security issues, including those in civil protection law. European and international dimensions of democratic guarantees complement the discussion. Against the backdrop of global political developments, the theme "Democracy and Law" proves its continued relevance for understanding and developing constitutional democracies.

Global Challenges in the Environmental Humanities

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. This book studies how international law is evolving to meet the challenges of the digital age. This book tries to answer this question by presenting a detailed analysis of how international law is responding or failing to respond to the digital economy.

The author investigates how leading countries with advanced digital economic systems, including the regulation of cryptocurrencies or digital trade and E-commerce in the European Union, China, and USA, have approached these issues. Taking the WTO and the UN as examples, the book examines the efforts made by these international institutions to retrofit traditional legal structures for a world increasingly defined by the internet. Can global trade rules designed for physical goods be applied to digital products and services? How can global institutions facilitate cooperation between countries with drastically different levels of technological development? These questions shape the discussion.

The approach used in this book does not only focus on the laws but also the growing technological world. The digital world is more dynamic than it is possible to regulate it through laws that may take a lot of time to be adopted and enforced. Some laws were drafted many years ago and may now be incomplete and full of loopholes and ambiguities. By mixing legal research with real-world examples, this book aims to provide practical insights into how international law can progress to address these issues at the front. This book provides the reader with a valuable understanding of the digital economy and its relationship with international law by integrating comparative legal analysis with insights regarding contemporary global economic conditions. In the European multi-level system, national law and EU law are linked in such a way that EU law establishes requirements for national private law in terms of its substance and, in some cases, its form, but never in terms of its doctrinal principles. Viktoria Kraetzig develops a paradigm for processing EU law in the national legal orders: the "blindness" of the higher level towards doctrinal concepts of the lower level. She points out that the legal actors in the Member States shall not use their own conceptual frameworks to interpret EU law and impose doctrinal thinking of their own system on it. Accordingly, the questions referred to the CJEU must be free of doctrinal assumptions inherent in the national systems as the court, as an actor of Union law, cannot be familiar with them. The CJEU delivers its judgments without knowledge of doctrinal concepts of the Member States legal orders' and without adjusting its answers to national doctrinal thinking.

Die Autorin widmet sich in ihrer Arbeit der bislang wissenschaftlich ungeklärten und höchst praxisrelevanten Frage, ob § 136a StPO auch bei entlastenden Beweisergebnissen anwendbar ist. Sie zeigt, dass ein Beweisverbot in dieser Konstellation weder verfassungsrechtlich zwingend noch kriminalpolitisch überzeugend ist und derzeit erhebliche Schutzlücken für den Beschuldigten bestehen. Nach einer Analyse der Grundlagen des Strafverfahrensrechts einschließlich eines rechtsvergleichenden Blickes auf Österreich und die Schweiz, entwickelt die Autorin auf dieser Basis einen konkreten Gesetzgebungsvorschlag, der die Beschuldigtenrechte stärkt und damit die Effektivität der Strafverteidigung nachhaltig verbessert.

Die Arbeit wurde mit dem DStV-Dissertationspreis 2025 ausgezeichnet.
