This book offers a machine-generated literature overview of the legal and ethical considerations, in the context of technological growth, over implementing privacy and data protection measures in the last three decades. &nbsp;It showcases the expectations and challenges in mapping and operationalizing the information privacy and data protection measures. It is the second of a two-volume exploration of the narrative, wherein both volumes have consciously tried to remain both jurisdictional and technology neutral while considering a range of data protection and privacy issues. Towards that end, this volume addresses these issues at a conceptual level while dealing with the question of implementing data protection expectations in different environments. It, however, looks at the operational question of implementing the expectations, positioning itself in a context of ‘conflict’ and ‘uneasiness’ that often is assigned to the question of technology and privacy. Therefore, the volume starts with chapters on these conflicts and contradictions before moving on to articles that effectively implement data protection principles in a tech environment. The following chapter gives us a sense of how privacy and data protection issues are no longer obscure incidents and have become a part of our everyday living. The next chapter provides a snapshot of examples where technical advancements offer effective and practical solutions in implementing data protection measures to protect the privacy of individuals. However, the chapter also portrays the extent of risks that such implementation may have on individuals. At the end, the final chapter captures how often privacy and data protection questions come between technical growth and advancement.&nbsp;The first volume, titled ‘Expectations vs Realities of Information Privacy and Data Protection Measures,’ captures overarching issues about data protection and privacy; conceptualizes data protection from different perspectives and its existing debates with other rights and developments in a democratic society; provides a snapshot of developments happening in various jurisdictions and how data protection framework engages with other laws. Ius Gentium: Comparative Perspectives on Law and Justice

The volume examines, from a legal point of view, various regulatory, political, technological and democratic issues related to the disinformation phenomenon in both "old media" (newspapers and broadcasting) and "new media" (digital platforms, social media and artificial intelligence) in two different scenarios: elections and war.
Disinformation is in fact relevant, inter alia, in light of two very significant events of recent years. First, 2024 marks a year of general elections in numerous regions globally, involving 76 countries (including, within our continent, the elections for the European Parliament as well as parliamentary and presidential elections in several EU Member States such as Portugal, Belgium, Austria, and, on the other side of the Atlantic, the Presidential elections in the United States). Second, 2025 is the fourth year of the Russia/Ukraine military conflict. The common thread that binds these two situations is clear: disinformation may significantly impact the formation of public opinion, thereby prompting public decisions that risk being based on false or seriously distorted news. Starting from the two-abovementioned scenarios, the chapters of the volume concern the current "state of health" of freedom of expression in both "old media" and "new media", and they contribute to answer three main questions. First, are governmental repressive, corrective or even preventive actions against "false" information in the two scenarios discussed here the right solution? Could any prohibition of disinformation rather lead, paradoxically, to the opposing result of producing a "chilling effect", in itself harmful to the free circulation of ideas, including those who "shock or disturb"? Second, is it still valid that the best antidote to disinformation and hate speech is more speech? Is this conclusion still correct in case of absence of pluralism in the media, when the main sources of information are controlled by one or few media companies? Third, is propaganda of war a specific situation that merits being distinguished from any other form of disinformation?

Die Frage, wann eine Kompensation bei einer aktien- oder umwandlungsrechtlichen Strukturmaßnahme als angemessen gilt, wird in der juristischen und ökonomischen Forschung umfassend untersucht. Neben der vom Bundesverfassungsgericht festgeschriebenen Verwendung des Börsenkurses als Untergrenze für die Bemessung der Kompensation steht der Börsenkurs insbesondere seit der neuesten BGH-Entscheidung auch als alleiniger Maßstab vermehrt in der Diskussion. 

In der vorliegenden Arbeit werden anhand eines eigens zusammengestellten, umfangreichen Datensatzes an Strukturmaßnahmen Hinweise auf eine Verwendbarkeit von Börsenkursen des deutschen Kapitalmarktes im Rahmen einer Abfindungsbemessung abgeleitet. Dafür werden verschiedene Kriterien herangezogen, beispielsweise die Informationsverarbeitung des Börsenkurses der Zielgesellschaft, die Liquidität der Aktien sowie ein bestehender Konzerneinfluss.

Das Verhältnis des Menschen zur KI ist Thema von Untersuchungen zu autonomen Künstlichen Intelligenzen und menschlichem Entscheidungshandeln. Risiken der KI-Regulierung wiederum liegen einer Untersuchung des Spannungsverhältnisses von AI-Act und der geostrategischen Wettbewerbsfähigkeit Europas zugrunde. Der Begriff der Cyberresilienz wird im Lichte der Künstlichen Intelligenz ergänzt um einen proaktiven und präventiven Begriff der Cybervigilanz. In ethischer Hinsicht wird das strukturelle Verhältnis von Bias, Diskriminierung und Fairness analysiert, eine umfassende weltanschaulich-religiöse Risikoperspektive entwickelt sowie die Prägung unserer moralisch-normativen Einstellungen durch synthetische KI-Realitäten untersucht. Durch all dies entsteht ein aufgefächerter Blick auf mannigfaltige Problemlagen, was bei der Leserschaft ein umfassendes und ganzheitliches Begreifen ermöglicht.
