Disclosure represents an evergreen topic in banking since it allows breaking down the opacity of the so-called "black box" banks. The recent failures of Silicon Valley Bank and Credit Suisse in March 2023 have reignited discussions about the role played by banking disclosure and its link to transparency, financial stability, and competition. Given these premises, this book comprehensively explains how banking disclosure has evolved in the last decades, shaping banks' behaviors and mainly investors' decision-making. The book provides an in-depth review of the field, highlighting theories and empirical studies about banking disclosure grounded on regulatory mandates and voluntary initiatives mitigating agency conflicts and addressing information asymmetries. Then, this book discusses banks' need to enhance their disclosure practices to comply with stress tests and contribute to sustainable development, particularly in light of climate change risk. To this end, an empirical investigation uncovers banks scrutinized by regulators and supervisors are more inclined to engage in green lending and prioritize borrowers' ESG disclosures, thus promoting a more sustainable economy. This book analyses the impact of CAFTA-DR and European Free Trade Agreements on the industrial property system in Central America. While there is ample literature on bilateral and regional FTAs, it is often limited to the contractual obligations assumed by the participating countries. This book goes a step further and analyses how these obligations are implemented through national legislation, institutional changes and legal practice. To provide a deeper understanding of the effects of FTAs on national IP systems, the book addresses research questions that go beyond general publications on the topic. Research questions include: Is the combination of market access and IP rules in a bilateral FTA an effective and appropriate trade deal? How are the IP requirements under the FTAs implemented into the national statutory framework? Do the IP rules of FTAs sufficiently address institutional factors necessary for an effective IP system? Do they provide for an appropriate balance between minimum protection and flexibilities and support relevant IP policy objectives? The book covers the CAFTA-DR member states Costa Rica, the Dominican Republic, El Salvador, Guatemala, Honduras and Nicaragua, reviewing the implementation of FTA obligations regarding patents, plant varieties, test data, trademarks, geographical indications, designs, genetic resources and traditional knowledge, enforcement and other areas. By looking at several countries, a broad range of IP rights and the practical implementation of FTA obligations, this book provides a broad range of information and insights.

Das Werk untersucht, wann Unternehmer im Umfeld von Transaktionsplattformen im Sinne des § 2 I Nr. 4 UWG als Mitbewerber angesehen werden sollten. Ziel der Arbeit ist es, für deren Konfliktbeziehungen eine Lösung zu unterbreiten. Die Erörterung geht dabei den Einzelheiten des Begriffs auf den Grund. Sie orientiert sich im Gegensatz zur bisherigen Definition des Mitbewerberbegriffs an der Beeinträchtigung unternehmerischer Kerninteressen. Unter bestimmten Voraussetzungen will sie ein Klagerecht der Plattformbetreiber gegen die Konkurrenten der Seller zuerkennen. Ziel ist die Erleichterung einer Lösungsfindung in zukünftig auftretenden Fällen, in denen die Mitbewerbereigenschaft für solche Unternehmer fraglich wird.

While much has been made of the details of the Industrial Revolution, what remains a mystery is why it took place at all. Why did this revolution begin in the West and not elsewhere, and why did it continue, leading to today's unprecedented prosperity? Bringing together economics, the history of science and technology, and models of cultural evolution, Mokyr demonstrates that culture—the beliefs, values, and preferences in society that are capable of changing behavior—was a deciding factor in societal transformations. Mokyr looks at the period 1500–1700 to show that a politically fragmented Europe fostered a competitive "market for ideas" and a willingness to investigate the secrets of nature. At the same time, a transnational community of brilliant thinkers known as the “Republic of Letters” freely circulated and distributed ideas and writings. This political fragmentation and the supportive intellectual environment explain how the Industrial Revolution happened in Europe but not China, despite similar levels of technology and intellectual activity. In Europe, heterodox and creative thinkers could find sanctuary in other countries and spread their thinking across borders. In contrast, China’s version of the Enlightenment remained controlled by the ruling elite.
