'Change in Precedent to the Disadvantage of the Defendant in a Criminal Case and the Principle of Non-Retroactivity. Attempt of a Specification with Special Respect to the ¿obligation to specify¿': The so-called ¿obligation to specify¿ by the German Federal Constitutional Court fueled support for a higher level of protection for the defendant in case of a change in precedent. The work at hand examines this issue. One conclusion is that the solution currently practiced by courts needs to be changed. An objective approach, which is necessary, should be based on Art. 103 II GG. This solution is specified for its practical use and applied to five cases of changes in precedent illustratively.
