Die Entscheidungsfindung von Richtern

Die Eignung der Berufung als Fehlerkorrektur vor dem Hintergrund statistischer und psychologischer Befunde

'The Decision-Making of Judges: On the Suitability of Appeal as a Means of Judicial Error Correction Against the Background of Statistical and Psychological Findings': The book examines cognitive biases in judicial decisions and specifically in appeal decisions. In doing so, Cara Warmuth includes methods and findings from statistics and psychology in her legal analysis. Her experimental study with 136 judges shows that appeal judges may tend to confirm the first-instance decision in an irrational way. To avoid this appeal-specific affirmation bias, the author proposes, among other things, a preliminary blind procedure at the courts of appeal.
