Die Eilkompetenz der Strafverfolgungsbehörden bei Gefahr im Verzug

Konsequenzen des Beschlusses des Bundesverfassungsgerichts vom 16. Juni 2015

'The Urgent Powers of Law Enforcement Authorities in Cases of Imminent Danger. Consequences of the Federal Constitutional Court's Decision of 16 June 2015': Once the case has been referred to the competent judge and the possibility of preventive protection of fundamental rights has been opened up, the urgent powers of the law enforcement authorities come to an end. An unjustified delay in the judge's decision may result in the loss of evidence. In addition to approaches aimed at improving communication and using the advances made possible by digitalization, the introduction of a special legal remedy in criminal proceedings that respects judicial independence could also help to resolve this issue.
