'Digital Examination of Evidence in Criminal Proceedings. With Special Regard to the Right to Defense': The digital examination of evidence has become central to modern criminal investigations. Measures under §§110, 100a and 100b of the German Code of Criminal Procedure increasingly raise issues of accessing digitally stored data across locations. At the same time, it poses significant constitutional and human rights challenges, especially regarding the right to effective defense. The study analyses the legal framework and proposes concrete reforms.
