Der Wal und das Ende der Welt

Roman

Warum meine Heimat mit dem Westen gebrochen hat | "Pflichtlektüre!" Markus Lanz

Für Russland ist Europa der Feind

By exploring the historic development of marriage laws and changing relationship norms in England, Qatar and Australia; the legal treatment of religious-only unions in light of the family law regime in each country, and the impact of non-recognition, this book reveals the complexities of the law reform needed to tackle these issues. This examination of the differing outcomes for couples who live in England/Wales where cohabitants have no legal rights, Australia where cohabitants do benefit from some legal protections, and Qatar, a Muslim majority state with a modern family law regime which ordinarily recognises religious marriages provides a broad canvas for exploring this issue in depth. The book looks at this very complex issue from a range of perspectives including autonomy, cultural transitions and legal pluralism. It examines the issue of religious-only marriages in order to convey the complex and interwoven narrative which signifies how multifaceted law reform must be in order to adequately respond to these transitioning relationship norms in any given jurisdiction. Of course, relationship norms are not static and they continue to evolve. In light of changing norms and practices, the theoretical framework for this book focuses on the concept of 'liminality' or transition, which is being witnessed in the processes and formalities by which Muslims are entering their marriages.

This book provides a timely and much-needed critical legal review of children's participation in healthcare that goes beyond merely documenting the extent and scope of participation, and explores the importance, definition of, and barriers to their meaningful participation. Addressing a gap in the literature, the book uses a combination of empirical data, childhood and participatory theory, and legal analysis to study the participation of children and young people in the medical context from a child's rights perspective. Centring the unheard and underrepresented lived experiences of recent and past child patients, and doctors, the book uses Interpretative Phenomenological Analysis, a methodology traditionally used in psychology, to provide a refreshing and unique exploration of children's participation in their healthcare. The book explores to what extent national law and international non-binding conventions have created a 'right' to participation, studies the application of national law in clinical practice asking whether the law facilitates meaningful participation, and analyses the interaction between law and quasi-legal regulations. The book will be useful for academics, children's activists, and legal and clinical practitioners.

Medical Decision-Making with Children and Young People

Are digital technologies really a silver bullet for development in the Global South?

Digital technologies are supposed to solve the challenges of climate change, projected population growth, land conflicts and food insecurity, especially in rural areas. Yet NGOs, government institutions, and private companies are increasingly adopting a trial-and-error approach as they recognize the limitations of transferring Western science and technologies to the global South.

This book presents the ambivalent practices and implications of digital pilot projects which aim to 'develop' both farming communities and locally adapted innovations in East Africa. Inspired by laboratory ethnographies in Science and Technology Studies, it explores the practices of testing and developing digital technologies in rural Tanzania. The multi-sited ethnography, which takes in agricultural fairs, conferences, documents, online courses, tech hubs, project offices, villages and fields, centres on three case studies, namely DAST (a digital land-formalisation tool), STAS (an AI system for agricultural productivity) and iPlus (an e-extension tool). Rather than viewing these technologies simply as welcome tools to promote connectivity, empowerment and increased production - as commonly advanced in development policy - this book foregrounds the (un)intended consequences of the planning, set-up, maintenance and results of digital pilot projects. Against the backdrop of conflicting logics between testing technologies and developing Tanzanian agriculture through them, this book considers their (un)predictable impacts on new actors, the character of development and the trial communities in rural Tanzania.

Key Ideas in Law

This book provides an account of the most important and controversial aspects of the principle of legality in the United Kingdom. The principle of legality describes a method of statutory interpretation that empowers courts to prevent fundamental common law values from being overridden by unclear legislation. However, it makes more sense to think of multiple principles of legality, rather than a single concept. The book provides a fresh and detailed perspective on a controversial aspect of the common law. It will be useful for students of law and politics, legal practitioners and scholars. It explores the many complexities surrounding the historical origins, fields of application, mode of operation, and subject matter of the principle of legality. Despite its long history, the term 'principle of legality' only began to be used in public law cases towards the end of the twentieth century. More recently, judicial references to the principle of legality in high profile constitutional law cases have fuelled broader concerns about judicial overreach. The book argues that these concerns are unfounded, and deeper principles of legality are required.

"Harry Bucknall leads us through the multicultural history of our island, with its diverse history and extraordinary quirkiness. Up fell and down river, across walls and dykes, from Iona to Dover, you are in safe hands as he steers a course of over 6,000 miles. A Road for All Seasons is a joy." Julie Summers "The kind of travel book that makes you want to lace up sensible boots and set off immediately" - The Halpern HotlistA journey of 6,518 miles, that filled 14 notebooks and encompassed all 4 countries of the United Kingdom, travelling through 42 out of its 95 counties, visiting 23 cities; requiring 75 trains, 60 maps, 26 cars, 16 buses, 9 ferries, 4 tubes, 4 uber taxis, 4 black cabs, 2 DLR, 2 vans, a canal boat, a probation service minibus, an intercontinental articulated lorry, a 1953 Morris Oxford and a pair of size 9 boots ... A tumultuous period in British politics left writer Harry Bucknall questioning whether he really knew the place he called home. Propelled by a growing desire to better understand his island nation, Harry decided to undertake a pilgrimage of sorts; he embarked on a series of four walks across Britain that would mirror the changing seasons, covering a distance of nearly 1,600 miles. From fresh and heady spring through to the gloriously crisp winter months, Harry journeyed across Britain visiting cities, towns and vast swathes of the countryside from Mull to Sunderland and Aberystwyth to Lowestoft, meeting a host of diverse and charismatic characters along the way as he strove to uncover the beating heart of the nation. Uplifting, joyous and charming, A Road for All Seasons is a vivid, social and cultural snapshot of 21st-century Britain. Focusing as much on the beauty of the fertile land as the people who inhabit it, it explores a unique culture, its folklore both past and present, as well as the wealth of the nation's history and heritage. Exquisitely written and filled with delightful people and places, this is Harry's ardent tribute to the British Isles.

This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. In presenting the National Parks and Access to the Countryside Act 1949 as part of a wider system of legal change, the book encourages the reader to think differently about national parks, emphasising the inherently legal nature of these spaces. This book is the perfect companion for any reader seeking to understand how national parks in England and Wales legally came to be.

This book applies the approach and methodology of 'Resilient Property Theory' (RPT), bringing together leading scholars to develop and test new approaches to housing and its relationships to private property and environmental sustainability. RPT analyses problems through multiple lenses, paying attention to the web of intersecting issues and stakeholders involved in contemporary housing studies: individuals (owners, tenants, precariously housed, homeless), aggregated interests (neighborhoods, communities, markets, social movements), and the state itself across its multi-layered actors, agencies and institutions (local/city; regional; national; transnational). It focuses on seeking out solutions that enable the production of resilience for different stakeholders and promote resilience within housing systems. This book focuses on providing greater synergy amongst a diverse range of perspectives, across disciplines (law, economics, history, political science) across a range of jurisdictions (US and Canada, England and Wales, Scotland, Europe, Australia and South Africa) and sets out to find sustainable solutions.

How apprenticeship shaped the English economy Apprenticeship dominated training and skill formation in early modern Europe. Years spent learning from a skilled master were a nearly universal experience for young workers in crafts and trade. In England, when apprenticeship reached its peak, as many as a third of all teenage males would serve and learn as apprentices. In The Market for Skill, Patrick Wallis shows how apprenticeship helped reshape the English economy. Some historians see apprenticeship as a key ingredient in the industrial revolution; others agree with Adam Smith in seeing it as wasteful and conservative. Wallis shows that neither of these perspectives is entirely accurate. He offers a new account of apprenticeship and the market for skill in England, analyzing the records of hundreds of thousands of individual apprentices to tell the story of how apprenticeship worked and how it contributed to the transformation of England. Wallis details the activities of apprentices and masters, the strategies of ambitious parents, the interventions of guilds and the decisions of town officials. He shows how the system of early modern apprenticeship contributed to the growth of cities, the movement of workers from farms to manufacturing and the spread of new technologies and productive knowledge. In this groundbreaking study, Wallis argues that apprenticeship succeeded precisely because it was a flexible institution which allowed apprentices to change their minds and exit contracts early. Apprenticeship provided a vital channel for training that families could trust and that was accessible to most young people, whatever their background.
