Die Arbeit untersucht, wie das Recht Interessenkonflikte von Parlamentariern effektiv einhegen kann, um der gegenwärtigen Vertrauenskrise der repräsentativen Demokratie entgegenzuwirken. Hierzu wird anhand rechtsökonomischer Methoden eine Konflikt-Matrix entwickelt, welche die vielschichtigen Konfliktlagen des politischen Prozesses systematisiert. Aus der rechtsökonomischen Perspektive zeigen sich strukturelle Parallelen zwischen den Konfliktlagen von Abgeordneten und Aufsichtsratsmitgliedern in privatrechtlichen Körperschaften. Ausgehend von rechtsgebietsübergreifenden Prinzipien korporativer Organisation erarbeitet die Studie Reformimpulse für das Abgeordnetenrecht und analysiert deren verfassungsrechtlichen Möglichkeiten und Grenzen.

It shows how trade secrets are routinely invoked to expand algorithmic opacity, limiting explainability to data subjects and regulators (ANPD). Beginning with today’s obstacles to data protection and transparency, the book maps the legal and technical frictions that undermine accountability, DPIA practice, data portability, and security‑incident notification.Brazil is one of the world’s most connected markets, with 183 million internet users (86.2% penetration), 144 million social‑media user identities (67.8% of the population), and 217 million mobile connections (102% of population) at the start of 2025. These scale effects make Brazil a bellwether for platform governance and data‑rights enforcement. Brazilians also rank among the top global users by time online (≈ 9h09 per day) and lead global time spent on social media (≈ 3h49 per day)—a usage profile that amplifies the societal impact of automated decision‑making and content curation. On the access side, 93.6% of households had Internet in 2024, underscoring mass exposure to data‑driven services. European Union and its Neighbours in a Globalized World

This book provides an in-depth and timely analysis of a relevant and controversial issue: the relationship between European Union values and international law. It examines whether and to what extent the EU succeeds in influencing international law by upholding and promoting its values (listed in Article 2 of the Treaty on European Union) globally, as explicitly provided for in Article 3(5) and in Article 21 of the Treaty on European Union, through its international agreements. In particular, the book focuses on the free trade agreements concluded by the Union with States and other regional organisations. The reason for this choice is based on the assumption that this is the area where the EU can make the most effective use of its soft power, which derives from its commercial strength and namely from the attractiveness of the access to its internal market. What makes this volume unique is its approach to the topic, tracing the historical and philosophical foundations of European values, both from a historical perspective and through comparative legal analysis. This solid foundation enables the reader to gain an in-depth understanding of the values that the Union seeks to promote in the wider world.
