Juridicum – Schriften zu Recht und Digitalisierung

Fremdsprachige Elemente prägen zunehmend den Alltag strafrechtlicher Verfahren. Die Gründe dafür sind vielfältig: Durchlässigere Binnengrenzen innerhalb Europas, globale Flucht- und Migrationsbewegungen, die Digitalisierung sowie internationale wirtschaftliche Verflechtungen. All das führt dazu, dass Gerichte und Strafverfolgungsbehörden immer häufiger vor Sprachbarrieren stehen. Dies betrifft nicht nur Verfahren gegen nicht deutschsprachige Beschuldigte, sondern ebenso fremdsprachige Beweismittel und internationale Ermittlungsmaßnahmen. Gleichzeitig ist die Strafjustiz mit begrenzten finanziellen und personellen Ressourcen konfrontiert.

Das Buch untersucht die aktuellen Rahmenbedingungen der Translation im Strafverfahren – von der Kommunikation mit sprachunkundigen Verfahrensbeteiligten bis hin zur Verarbeitung fremdsprachiger Beweise und der Unterstützung bei Ermittlungsmaßnahmen. Analysiert werden bestehende Strukturen, rechtliche Anforderungen und praktische Defizite. Im Mittelpunkt steht die Frage, ob und unter welchen Voraussetzungen Anwendungen Künstlicher Intelligenz in diesen Konstellationen eine rechtssichere Unterstützung bieten können. Die Arbeit zeigt Chancen und Grenzen moderner Technologien auf und beleuchtet, welche Bedeutung KI künftig für die Gestaltung effizienter und zugleich rechtsstaatlich abgesicherter Strafverfahren haben kann.

The advanced capitalist democracies of the 21st century are the richest, freest, healthiest, best educated, and best governed societies in history. Why then does it seem like everything is falling apart? Economic stagnation is spreading, class divisions are deepening, birth rates are collapsing, mental health problems are on the rise, faith in democracy is in decline, and pessimism about the future abounds. According to Lindsey, 21st century capitalism is in the grip of three interrelated crises: a crisis of inclusion, as vital social ties and personal connections are breaking down; a crisis of dynamism, as capitalism's engines of innovation and wealth creation have begun to sputter and seize; and a crisis of politics, as the mechanisms for collective decision-making needed to address capitalism's growing problems have been degraded by the very same dynamics that underlie those problems. A much brighter future is possible, and Lindsey charts an intriguing path to get there. There is no need to concoct a radical new social system. Instead, capitalism needs to be refocused on its core mission of extending the technological frontier, and rebalanced through the revitalization of face-to-face communities. This book presents a unique account of the social and political impacts of the German Basic Law on the German Republic from 1949 to the present day. It considers the way in which the history of the Federal Republic of Germany has been decisively influenced by its Constitution, the Basic Law of 1949, and by the jurisprudence of the Federal Constitutional Court. The book argues that the historiography of the Federal Republic does little to reflect this influence. The Basic Law is mentioned and so occasionally rulings of the Federal Constitutional Court. But the reader does not get the impression that they were of specific importance in Germany before and after reunification. Legal scholars, on the other hand, are concerned about the legal consequences of the Basic Law, but do not analyse its impact in the real world. There is, thus, a gap between the two disciplines - one not being familiar with social reality, the other not familiar with the normativity of the law. The history of the effectiveness of the constitution falls into this gap. In this book, Dieter Grimm, himself a Justice of the Federal Constitutional Court from 1987 to 1999 and an expert on interdisciplinary research in law, history and political science, guides the reader through important developments and events that were determined or influenced by the constitution and its judicial interpretation.

Influenced by wide-ranging ideas from land art and institutional critique to experimental cinematic practices and narrative film, the groundbreaking work of Pierre Huyghe since the early 1990s has arguably, even indelibly, altered the landscape of contemporary art. The French artist works at the beguiling intersection of fiction and reality, representation and performance, spectacle and memory, chance and agency, living organisms and technological entities. As formats and discourses of cinema (be it Godard or Lumet) and architecture, (invented or existing) holidays and games, (puppet) theatre and opera, fairy tales and (travel) literature, museology and computer technology, life sciences and popular culture (like Manga comics or Disney movies) are renegotiated in Huyghe’s variegated projects, the methods and modalities of producing, exposing, and experiencing art, in turn, come under both critical scrutiny and allegorical speculation.
