¿This book provides a comparative perspective on the impact of the COVID-19 pandemic on different criminal law systems. To this end, the book brings together country reports from Brazil, Argentina, Spain, Portugal, Italy, Austria, Sweden, the Netherlands, Germany, Poland, France and Belgium.
All country reports address the same key issues in order to facilitate comparative conclusions. Those key issues re: criminal liability for spreading the coronavirus, criminal liability of medical staff in triage situations, criminal liability of political decision-makers, as well as further (country-specific) challenges in the context of the pandemic and criminal law. Despite the remarkably serious problems caused by aging and population decline in Japan, there are very few books that inform the world about them in English. Through this book, a Japanese economic demographer clearly shows the various economic consequences of population problems in Japan, especially the impacts of continuing ultra-low fertility and the world's highest life expectancy in the post-demographic transition phase. The explanation is at a basic level but covers the overall economic issues including labor, capital, technical progress, consumption, savings and investment from a demographic perspective. Finally, some remedies for economic growth in Japan are proposed. Because economic policies are expected to have short-term effects while demographic ones to increase the fertility rate need some time to take effect, earlier books about the Japanese economy have hardly ever dealt with demographic policies. Furthermore, this book directly addresses the integrated economic and demographic policies appropriate to Japan. These are different from the French natalistic social policy, the Scandinavian policy of a work-life balance or the immigration policy in Australia or the United States. This book emphasizes the power of local communities in Japan as a part of East Asia. In this sense, the book provides a new key to readers who are interested in the future Japanese economy and population.

This book explores the use of the doctrine of good faith in the common law when interpreting contracts and resolving disputes.

This doctrine is well-accepted in civil law, is reflected in international commercial law, and is a fundamental aspect of private law in the USA. However, its use in the UK is extremely limited. Inconsistent application has given rise to confusion and uncertainty. This apparent antipathy is somewhat hard to fathom, given its previous widespread acceptance in English law.


The book explains in depth the history of good faith in English law, and clarifies its current status in English, Australian and international law. It explores the relationship between good faith within contractual relations and the neighbour principle in tort law, and notes the workability of good faith in the commercial context of insurance. This will be welcomed by contract lawyers in both common law and civil law jurisdictions. A subsequent volume will explore how acceptance of good faith in the law might lead to a re-interpretation of existing contract law doctrine.

This open access book addresses the application of EU fundamental rights law by national courts. It offers a unique insight into the case law of courts in three EU Member States (Belgium, Germany and the Netherlands) as regards mutual trust and fundamental rights. Through a thorough analysis of over 1000 national court judgements from the last ten years, the book enables readers to view EU law from the perspective of national judges.
The book focuses on decisions regarding transfers under the Dublin Regulation and the European Arrest Warrant. These particular cases require national judges to balance the EU legal principle of mutual trust with individual fundamental rights. This is a demanding task due to the differences in approach between the Court of Justice and the European Court of Human Rights, as well as the inherent tension between the principle of mutual trust and fundamental rights. The book investigates how national judges navigate the differences in applicable laws (EU law, ECHR law, national law) in Dublin and EAW cases. Moreover, it dissects how and when national judges decide to allow or refuse a transfer, along with their legal reasoning. Finally, the manner in which national courts have utilised the preliminary reference procedure in these cases is considered.
This book will appeal to anyone interested in understanding how EU law works in practice and in the role of national courts, as it explains how national judges may approach similar questions of EU law differently.
