This book offers a pioneering and deeply insightful examination of one of the most challenging dilemmas in contemporary counterterrorism and international law: how to legally and morally assess the responsibility of female suicide bombers affiliated with terrorist groups such as Boko Haram. It exposes a critical legal blind spot where female bombers are caught in a 'grey zone' - neither fully prosecuted nor released - due to conflicting norms around gender, victimhood and terrorism. Drawing on extensive research including interviews, case studies of failed suicide bombers, and legal analysis of terrorism cases, it develops a novel culpability framework that moves beyond simplistic notions of guilt or innocence. By exploring the complex spectrum of moral and legal responsibility, this framework offers a much-needed tool for policymakers, judges, practitioners, academics and students dealing with terrorism, war crimes and transitional justice. It challenges prevailing gender stereotypes that often either criminalise women excessively or excuse them arbitrarily and instead provides a nuanced approach that recognises female bombers as individuals whose actions range from coerced victimhood to accountable perpetrators. It considers women in academia, which was, in theory, open to women before they could become lawyers in most European countries. And it considers women working beyond the academy: many studied legal history in other ways; in local history societies, through archival work, and via activism. Women legal historians have been under-recognised or forgotten altogether, even where they made substantial scholarly contributions. In focusing on the work of women in legal history, this book lays the foundations for a transformational reassessment of the discipline. It asks searching questions about what counts as legal history. It demonstrates that work by and about women should appear in our legal history courses, be discussed in our seminars, and be cited in our academic work. If the field of legal history is lively, innovative, and wide-ranging, everyone working in it benefits. By shining a light on undervalued scholarship, and areas which have received insufficient attention, we challenge assumptions in our discipline and advance its methods. Whilst some women were pioneers and worked to change gendered aspects of the law, others led more ordinary lives, disappearing from the gaze of legal history even as they contributed to it. This book offers an analysis of how the European Court of Human Rights engages with identity and emotion, revealing both the promise and the limitations of human rights law in addressing the complexities of human experience. The book explores how human rights law, often framed as universal and abstract, responds to deeply personal questions of identity, belonging, and emotional impact. Based on a systematic study of over 3,300 judgments, the book shows how the European Court of Human Rights has increasingly made identity central to its reasoning - particularly in cases involving sexuality, ethnicity, and family life. In these areas, the Court acknowledges how state actions shape emotions such as fear, humiliation, and dignity. Yet, in other domains - migration, religion, professional life - the Court avoids emotional engagement, leading to troubling inconsistencies. The book argues that when emotions are excluded from legal reasoning, individuals are reduced to formal entities, stripped of depth and interiority. Combining doctrinal analysis with insights from social theory and psychology, the book presents a new framework for understanding how emotions and identity interact with law. It traces the evolution of identity references across categories and highlights the Court's uneven treatment of emotional harm. This timely and original contribution speaks to legal scholars, practitioners, and theorists interested in human rights, identity politics, and the emotional dimensions of law. It calls for a more responsive and empathetic human rights jurisprudence - one that reflects the lived realities of those it seeks to protect.

This book offers a foundational rethinking of how international law engages with non-state effective territorial entities - territories that, while legally part of a recognised state, are de facto governed by non-state actors or other states. These entities - ranging from ISIL-controlled areas in Syria to the contested territory of Crimea, the autonomous Somaliland, and Taiwan - occupy an increasingly prominent place in global politics, yet remain inadequately addressed in legal doctrine. Rather than assessing these territories through the binary lens of statehood, the book begins by assuming their non-state status and asks: what legal capacity and responsibilities do such entities hold under international law? It considers their obligations toward both other states and the populations under their control, and explores the broader implications for concepts like sovereignty, territorial integrity, and recognition. Drawing on four case studies across a spectrum of state-likeness, the book moves beyond isolated analyses of conflict or self-determination to offer a more holistic account of what these entities reveal about the limits and possibilities of the current international legal framework. It argues for a more functional, capacity-based understanding of legal responsibility that acknowledges the realities of territorial control without forgoing the notion and role of statehood. Combining doctrinal clarity with pragmatic ambition, this book challenges the state-centric foundations of international law and offers a roadmap for engaging with one of its most pressing contemporary challenges: the legal accommodation of non-state territorial authority in a world still structured around states.

This book argues that patient autonomy and medical negligence make for strange bedfellows. The emphasis on autonomy has distorted orthodox negligence principles, contributing to uncertainty and angst amongst healthcare professionals while eroding trust in the doctor-patient relationship. This work takes the current discourse beyond autonomy - which focuses on the rights of the patient, to agency and shared decision-making - which focus on the relationship between doctor and patient. The core argument is built on a review of the theoretical foundations of negligence and the philosophical conceptions of autonomy. Provocatively, this work argues against a rights-based approach to negligence - which can be confrontational - in favour of a human obligations approach, which is collaborative and thus well suited to the doctor-patient relationship. Drawing on the theoretical analysis, the book identifies doctrinal anomalies in the duty of care, standard of care, causation, and damage. It critically analyses landmark UK Supreme Court cases, including Chester v Afshar, Montgomery v Lanarkshire Health Board, and McCulloch v Forth Valley Health Board, arguing that the law is increasingly detached from the realities of medical practice and reasonable expectations of patients. Primarily based on UK law, the work also discusses Australian, Canadian, and Singaporean law. The book is aimed at the medical and legal fraternities as well as students and scholars of tort law. Doctors and lawyers will gain fresh insights into medical negligence; scholars will find an alternative perspective to orthodoxy with rich material to rethink theory and doctrine in negligence.

This book explores the often-overlooked democratic principle of 'rotation of power'. It considers two key questions: what happens when power stops changing hands in a democracy, and when incumbents manipulate the system to entrench themselves in office, can democracy survive? Democracies are often celebrated for their ability to ensure accountability and renewal through the peaceful and unhindered alternation of power. Yet, they are not immune to a dangerous phenomenon: political self-entrenchment. This phenomenon occurs when incumbents, unilaterally or collectively, exploit the power of office to dominate the political arena, tilt the playing field, and distort democratic competition. Contributing to scholarly and judicial debates, this book offers a fresh perspective on this issue by focusing on the cornerstone value of democracy: the rotation of power. Through sharp analysis and case studies from multiple jurisdictions, this book tackles the following critical questions: why is the rotation of power fundamental to democracy? How do incumbents undermine it? And, crucially, how can we protect democratic competition from those who seek to monopolise power?

This book defends the relational approach to law. It begins by exploring how law is constituted in the context of either rational or reasonable conduct. Having identified reasonableness as the unifying theme of natural law theories, it argues that the form and authority of law originate in the practical resolution of a moral antinomy that these theories leave unaddressed. The reasonableness of law lies in the structure and principles of relations in which rights are correlated with obligations and powers with liabilities. Rather than descending upon us from above in the form of directives, law emerges from our interactive efforts to cope with persistent moral disagreements. Ultimately, the relational approach views the legal rules governing our interactions as expressions of a common will. The book concludes that, unsurprisingly, modern constitutionalism represents a thoroughly pragmatic and most defensible conception of the authority of law.
