Deep Cuts

Fentanyl is a first-person, insider account of how the crisis consumed the Biden Administration amid a series of other national security emergencies. It follows Jake Braun, a senior White House official, and his colleagues while they scramble to respond to the epidemic. As Mexican cartels ruthlessly executed their most radical transformation in 50 years, Braun and his colleagues architected the first U.S. government wide strategy to combat fentanyl in history. The effort brought him to Mexico to meet with Mexican agents who kick down cartel doors for the U.S. government there. He also spent time with data analytics wizards buried in nondescript offices in Virginia suburbs that hunt down Chinese fentanyl precursor chemicals on the Dark Web. He even takes a detour to gather intelligence from Russian migrants in U.S. detention facilities that migrated through cartel-controlled areas of Mexico. In the process, Braun uncovered the remarkable transformation cartels in Mexico underwent over the last 50 years. They morphed from narco-empires the size of Fortune 50 companies specializing in marijuana and cocaine to ones specializing in human migration and, separately, fentanyl. After much painstaking effort, the Biden Administration successfully executed the most sweeping takedown of cartel leadership and fentanyl infrastructure since the crisis began. Due to the efforts of heroic agents, intelligence officers and national security experts, the leviathan U.S. government is now marshaled in ways never before imagined against the Chinese chemical companies and cartels propagating the fentanyl epidemic. In 1960, as the Algerian War for Independence entered its sixth year, 22-year-old Djamila Boupacha was arrested for allegedly planting a bomb in a university cafeteria. While in custody, she was tortured and raped by French soldiers. Her case would have been buried like countless others had it not been for the efforts of her lawyer, Gisèle Halimi, and the philosopher Simone de Beauvoir to transform it into an international cause célèbre. Djamila Boupacha is the culmination of this campaign to expose the systemic violence of colonial rule. This open access book investigates the role played by copyright on the digitisation of cultural heritage from three angles: the theoretical differences between cultural property law and copyright; a comparative analysis of the EU, UK, and US; and analysis of current practices and concerns, based on empirical research. As heritage digitisation projects become increasingly common for purposes such as preservation and access, the impact of copyright is also becoming more problematic. In order to provide a full and current picture of the copyright problem, the book first introduces the reader to the debates on the scope and ownership of cultural heritage and provides an overview of the copyright implications of the digitisation process and newer uses, including 2D and 3D scanning; virtual and augmented reality; text and data mining; and artificial intelligence. The author then divides the main critical analysis into three parts, referred to as the 'clashes with copyright'. The first, clash in theory, lies between cultural property law and copyright justification theories. The second clash is in the different legal approaches to digitising in-copyright, public domain, orphan, out-of-commerce and unpublished works in the chosen jurisdictions, focusing on the relevant rights and defences. The third clash is in the interests of stakeholders, based on public reactions to existing projects and cases, supported by interviews with heritage professionals engaging in digitisation. By placing itself in this particular intersection of law, heritage, and technology, the book will be of interest to both intellectual property academics and cultural heritage professionals.
