This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

Der Leser wird systematisch durch die wichtigsten Bereiche des Kapitalmarktrechts geleitet. Zur aktuellen Auflage:

Berücksichtigt wurden in dieser Auflage zahlreiche Änderungen durch den deutschen und europäischen Gesetzgeber; insbesondere in Bezug auf den EU-Listing Act (VO (EU) 2024/2809), dessen Regelungen teilweise seit dem 4.12.2024 oder dem 5.3.2026 gelten, teilweise aber erst zum 5.6.2026. Vorgreifend wird in dieser Auflage der Rechtsstand ab dem 5.6.2026 wiedergegeben und auf die vorhergehende Rechtslage nur am Rande eingegangen. Intensiver als bisher wird auch die EU-Verordnung über Märkte für Kryptowerte (MiCAR) sowie das Kryptomärkteaufsichtsgesetz (KMAG) einbezogen. Noch nicht finalisiert und deshalb nicht berücksichtigt werden das Standortfördergesetz (StoFöG, RegE BT-Drucks. 21/2507 v. 3.11.2025, vom BT am 19.12.2025 beschlossen) und das Fondsrisikobegrenzungsgesetz (FoRG, RegE BT-Drucks. 21/3510 v. 7.1.2026).

Scotland does not have a 'law of contract', as most comparable jurisdictions do, but rather - due in large part to the intellectual innovations of Viscount Stair - possesses a unitary 'law of voluntary obligations', of which contracts form but a part. This fact is highly significant, but is frequently overlooked. Indeed, the significance of this has even been overlooked by the Scottish Law Commission, who have recently proposed to significantly reform the 'law of contract' in Scotland by urging the passing of a statute which, among other things, would abolish the so-called 'postal acceptance rule'. This short book takes the view that the proposed reforms are wrongheaded and would be deleterious to the coherence of the Scottish legal framework. To that end, it examines the taxonomy of obligations pioneered by Stair, indicates that the application of that taxonomy to situations such as the process of contracting by distance suggests that there is in fact no 'postal acceptance rule' in this jurisdiction and suggests, in light of this, that reform of 'contracts' and the formation of, in Scotland, is better left to the courts and jurists than to the Scottish Parliament (or, for that matter, Westminster).
