Mert Kilic provides a comprehensive analysis of the de lege lata regulation of algorithmic trading. He examines the origins, objectives, and systematic structure of the applicable legal provisions and evaluates their legal and practical effectiveness. The central guiding question is whether the current regulatory framework is both practicable and legally sufficiently precise. Beginning with the historical development of algorithmic trading, the study discusses the legislative motives and the legal-political justification for its regulation. The author defines the legal nature of the relevant provisions and explores how the concept of algorithmic trading is legally framed. In doing so, he examines whether the de lege lata definition encompasses trading via brokers, over-the-counter (OTC) transactions, or manually initiated orders, and how algorithmic trading is to be distinguished from the more specific category of high-frequency trading.
 

 As part of the analysis of existing obligations for algorithmic trading firms, potential avenues for circumvention, enforcement deficiencies, and future developments are also identified. Furthermore, the supervisory and civil law consequences of regulatory violations are presented, with particular attention to liability issues arising from damages or system disruptions. Kilic also draws a comparative analysis with U.S. regulation in order to highlight differences and identify potential reform impulses for the de lege lata framework. The study concludes with a critical assessment of the current regulation, finding that the need for regulation in algorithmic trading exists only within narrow limits and that the de lege lata framework is in part indeterminate, excessively technical, and ultimately of limited practical suitability.

Over the last twenty-five years, the concept of per-sonhood has become central to many contentious debates. Corporations have won free speech protections, as if they were individuals. The right to life or freedom has been claimed on behalf of fetuses, trees, and elephants. The fund of human rights is spilling over into the nonhuman. The Problem of Personhood reveals the unsettling consequences of granting rights to imagined persons, such as Sophia the robot citizen or New Zealand’s Whanganui River. Synthesizing the political and phil­osophical debates on personhood and drawing on a varied cast of thinkers that includes Simone Weil, Hannah Arendt, and Dr. Seuss, Lisa Siraganian un­covers the disturbing impact of this contemporary development. Awarding rights to robots and rivers all too easily becomes a legal tool to turn people into capital. When robot Sophia is made a citizen, "she" is transformed into a subject in the law without the corre­sponding legal duties that protect us from her. At the root of this trend is the US Supreme Court’s Citizens United ruling that grants First Amendment rights to corporations as if they were individuals. The result has not been the transformation of things into humans so much as humans into things, when animals and the environment would be better protected with reference to our humanity rather than to theirs.

Elf Jahre lang ermittelte die Polizei in einer der größten Mordserien der Nachkriegszeit. Neun Migranten und eine Polizistin wurden hingerichtet. Die Washingtoner Prinzipien von 1998, fordern die Signatarstaaten zu "gerechten und fairen Lösungen" im Umgang mit "NS-Raubkunst" auf. This is a book about law and its impact on our practical reasoning. Drawing from Bernard Williams, the book argues that our practical engagements with the law are complex and often obscure. It begins with a novel view on practical reason that is called open-minded reasons internalism. This is a view that emphasises how certain considerations can bear on action for concrete agents, and in doing so it is an explanatory account of reasons and actions. The account is receptive to the considerations that makes much of people's lives: the motivations and dispositions they have, the notions of character and identity, and respect. The book claims that this account helps in making sense of much of the richness seen in real life in how concrete agents engage with the law. It provides the tools to explain when and why an agent identifies herself totally with the law, as Inspector Javert did in Les Misérables, but it can also explain the attitude of respect that many law-abiding citizens have, and even the merely prudential considerations of OW Holmes' famous 'bad man'. What emerges from this book is a view on law and practical reason that takes seriously the phenomenology of action. This book will be of interest to anyone interested in philosophical accounts of how we engage our practical reasoning with complex social practices.

This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations.
