Book V: Of the Revenue of the Sovereign or Commonwealth

Studies in the History of Law and Justice

This book helps to conceptualize the doctrine of forcible protection of nationals abroad and illustrates the key elements of state practice. States’ interest in protecting their nationals abroad is timeless; nationality and allegiance are constitutive elements of sovereignty and in some cases, take precedence over territoriality. Yet the forcible protection of nationals abroad has long been debated and attracted the attention of international legal theory. Currently, it is particularly in the spotlight due to Russia’s invocation of the doctrine in the armed conflict against Ukraine. However, protection of nationals abroad is a concept which is expected to fuel international debate in the years to come, primarily because of globalization and the growing trend of more and more people living outside their country of birth.Chapters 1 and 2 delve into the doctrine of protecting nationals abroad. More specifically, Chapter 1 examines how the doctrine was formulated and applied in the pre-Charter era and explores whether there was a customary rule permitting the use of force to protect a state’s nationals abroad, while Chapter 2 offers an overview of the doctrinal debate which followed the United Nations Charter and the prohibition of the use of force. In turn, Chapters 3 and 4 take a closer look at state practice from 1945 onwards. Chapter 3 outlines the major features of states’ practices and their justifications for using force for the sake of their nationals. Chapter 4 assesses the Russian discourse on the protection of nationals abroad, specifically with regard to the armed conflict with Georgia, the rhetoric preceding the annexation of Crimea, and the military invasion of Ukraine. Lastly, Chapter 5 explains how the protection of nationals abroad could be made more human-centric and go beyond jus ad bellum. This chapter re-interprets the concept of “nationals” and sheds light on the terms “expatriates,” “naturalized foreigners” and “diaspora,” suggesting that there is a gap between diplomatic and forcible protection, one not reflected in international law regulation and which needs to be addressed.

This book argues that when parties assert that a sovereignty dispute prevents adjudication of a maritime dispute, adjudicators are competent to determine whether a sovereignty dispute--in fact and in law--exists. Through a detailed analysis of key cases, including those concerning the Chagos Archipelago, the South China Sea, and Russia's annexation of Crimea, the book argues that adjudicators should apply ordinary scrutiny to evidence concerning territorial claims rooted in the use of force but that an exaggerated caution about the supposed limits of their authority has led them in key cases to fail in that basic part of the adjudicator's function. Examining and critiquing the February 2020 Annex VII award in Coastal State Rights, the book suggests that adjudicators would better implement the terms of UNCLOS and serve the legal system at large if they considered decisions of other international organs when these reflect consensus as to findings of fact and that they should also adhere to the standard methods of fact-finding familiar to parties and adjudicators in most legal systems. Timely and thought-provoking, this book invites a fresh look at an enduring problem made all the more urgent by the many uncertainties in present-day geopolitics.

This book delves into the legal and labour history of the Hashemite Kingdom of Iraq to explore the role international law and its institutions played in Iraq's state formation. Focusing on a turbulent period in global and Middle East history, it shows how the case of Iraq became a laboratory for experimentation with the concept of sovereignty by the Permanent Mandates Commission of the League of Nations in Geneva. This resulted in the development of a doctrine of 'semiperipheral sovereignty' to justify Iraq's independence from the Mandate process. This novel doctrine and its operation within the provisions of the 1930 Anglo- Iraq Treaty ensured the maintenance of British dominance over Iraq, especially to safeguard the extraction and transportation of its valuable oil resources to Western markets. The book traces how this legal doctrine impacted the everyday lives of working class Iraqis. It explores the governance of the extraterritorial spaces of capitalist accumulation and labour exploitation, in particular the Iraq Petroleum Company oil fi elds, the Iraq State Railways and the Port of Basra. It goes on to detail how the oil, railway and port workers led by the Iraqi Communist Party effectively organised themselves into a nationalist revolutionary labour movement. They waged an anti-colonial struggle against these imperial legal structures to improve their lot, leading up to the 1948 Wathba, the 1953 Intifada, and ultimately the July Revolution of 1958, which upended the British-sponsored monarchy. Spanning various international archives and Arabic primary source materials, this book offers an example of a social, legal and labour history written from below, centering ordinary working peoples' agency in the historiography of international law. Drawing on Third World Approaches to International Law (TWAIL) and Marxist methodologies, it emphasises the signifi cance of the semi-periphery in the making of the international legal order.
