This book integrates diversified disciplines, research approaches, and methodologies of area studies, regional economic development, and regional science. With its huge population, China has accomplished rapid economic growth since the 1990s, although the significant income gap among regions and individuals has become a serious problem for its society. China's accession to the WTO in 2001 has had various influences on the entire food system, from agriculture to consumers, through the food manufacturing and distribution industries. The changes in the Chinese food system are considered to have also affected the agriculture and food industries in Asian countries where economic interdependence has been promoted in past decades. The author argues these issues based on interdisciplinary and multi-disciplinary methods and approaches and has successfully derived empirical and theoretical results that are rich in policy implications. The topics addressed include food security and sustainability of agriculture especially in the suburbs of big cities; poverty reduction in rural agricultural areas amidst prosperity in urban and coastal areas; regional networks and international trade of the food industry in East Asia; creation of innovative knowledge and human capital for clustering of the agro-food sector; regional development strategy; and international cooperation. This book offers the first ever in-depth analysis of the emerging constitutionalism in South Sudan and the challenges it faces. The book critically analyses the constitution-making processes that occurred in South Sudan between 2005 and 2011, finding, among other things, that there was a failure of constitutional discourse, particularly in relation to the 2011 drafting process of the Transitional Constitution. It goes on to analyse how the constitution is being implemented. It finds that, despite the clear division of powers and functions between the national government and the sub-national governments, what has emerged in South Sudan in the post-constitution-making period is a form of coercive centralism where the national government controls much of the political decision-making process. This has had serious implications for democracy, constitutionalism, and the rule of law. Finally, bearing in mind the failure in both how the transitional constitution was made and how it is being implemented, the book undertakes a critical analysis of the proposed process for drafting a new constitution for South Sudan. It identifies serious shortcomings and proposes how these could be addressed to enhance the process.

This book examines the interplay of professional norms and political accountability in the process of making decisions about whether, how, and how much debt state and local governments should incur. The careful analysis of accountability in actual decisions, focusing particularly on whether and how individual and collective decision-making behavior responds to general (stipulated) norms and situational (negotiated) expectations in their broader social contexts, is a familiar approach in the study of management and public organizations generally, but has not been extensively applied to this area of public financial decision making. Political economists, especially those identified with the public-choice approach, have done extensive macro-level normative and theoretical analysis of public debt, but not in an empirically rich fashion. This book therefore constitutes a missing link that uses analyses of selected cases to advance conceptual understandings of organizational accountability spaces in general, and decisions to incur public indebtedness and the implications of those decisions specifically, by examining the intersection of the macro, meso, and micro levels of expectations for and practices of public financial decision making.

Drafting Agreements in Life Sciences

Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights. This open access book offers a unique perspective on the return of cultural objects by considering the aftermath of the handover processes. While calls for the repatriation of heritage have been made since the start of the decolonisation process, it is only in recent years that the debate on returning cultural objects has gained widespread prominence. This has been followed by ongoing efforts from several countries to change the legislation, adopt principles, and invest in provenance research to turn repatriation into a more proactive mechanism. The book tells the story of cultural objects that were housed in European institutions and returned to countries in Africa, Asia, and the Americas. In addition to in-depth analysis of relevant laws and policies, each of the case studies integrates interviews with those who were directly involved in those return processes, as well as those who were impacted by them, including museum staff, government representatives and community members. The book presents previously unheard insights into past return processes, the manifold modalities that such processes have followed, and, at times, unexpected outcomes. Exploring the Stories of Cultural Objects After their Return

This book explores the foundations of the principle of altruism and its relationship to the criminal law, examining the contrasting justifications for the duty of easy rescue and the duty of tolerance, both of which are based on altruism. Since the days of Lord Macaulay and James FitzJames Stephen, it has been said that English law does not usually punish omissions, and that altruistic duties are incompatible with the spirit of the common law. This book aims to show that this is not an accurate description of English criminal law, and that there is a strong case to be made for the opposite understanding, based on principles advanced by authors such as Adam Smith, Jeremy Bentham, John Stuart Mill and others. By analysing the duty of easy rescue - which imposes on individuals a duty to take steps to rescue a person in danger if this can be done without risk to the rescuer, or at least a duty to call the emergency services - and by comparing it with the well-known duties arising in cases of extreme necessity, it can be shown that altruism has plenty to say in different parts of the criminal law. Having established the case for criminalising the failure to provide a simple rescue, a detailed analysis is made of the form that this criminalisation should take, bearing in mind the basic principles of English law and considering the strengths and weaknesses of the duty of easy rescue as it is formulated in various continental systems, including the German, French, Spanish and Italian criminal codes.
