Because here on the high seas, everyone's hiding something - and no one can escape what they've done . . . Below The Deck

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. This enables the author to present a range of methods of establishing facts, drawing inferences, using legal sources and relying on policy arguments. By closely examining selected Tort judgments from both jurisdictions, the book elucidates the phenomenon of law-making through adjudication in both a non-codified and a codified system of liability. It offers a reflection on different approaches legal systems may adopt to the importance in the process of judicial justification of such issues as certainty and truth, common sense, consistency with previous judicial decisions and policy.
The book connects the choice of approaches in judicial reasoning in Tort law with its procedural and institutional context.

This landmark collection provides new insights, concepts and techniques to understand and respond to tort claims based on illegal conduct. It is the first comparative study of this difficult field, which has remained contested despite numerous decisions of the highest courts in the common law world. The collection draws on scholars from common law and civilian jurisdictions spanning Argentina, Australia, Brazil, England and Wales, France, Germany, Italy, the Netherlands, Scotland, Singapore, Spain, South Africa and Sweden. Together they set out fact patterns, and justifications for tort liability to illustrate the coherence and unity that exists when courts address such claims. While common law legal systems have developed a specific defence of illegality for some of those fact patterns, civilian jurisdictions tend to see illegality operating, if at all, through the existing components of tort liability. The book explains how these different approaches have been reached, how they work, and what they reveal about reasoning in tort.

This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com Open access was funded by the European Research Council.

The Rights of Performers, Composers and Playwrights in France 1890-1950

Performance as Intellectual Property

A nostalgic tale of two lovers' journey through post-war France, from the author of SO LONG, SEE YOU TOMORROW It is 1948 and a young American couple arrive in war-torn France for a long holiday. Full of anticipation and enthusiasm, Harold and Barbara Rhodes find themselves enchanted by the glamour and charm of Paris. But as they travel further into the countryside they meet a people still overcoming devastation, and their reception at the Château Beaumesnil is not all the open-hearted Americans could wish for. Luxuriously meandering and joyously observant, The Château sees William Maxwell bring to life the soul-enriching experience of what it means to truly travel and open oneself up to new life. 'Surprising on every page... I ended The Château feeling very sad that it was over' Brandon Taylor, author of Real Life 'Reading The Château is like meeting a very old friend with whom the conversation is always spontaneous, intimate, restorative and unpredictable' Salley Vickers

The Chateau

'His brutal best' - New York TimesA girl is missing, leaving no leads, no hope, no point - it's just the case for Eugène Tarpon. Tarpon is sleeping in his office once again, when he's offered a job he's too broke to refuse. A distant relative wants him to investigate her daughter's disappearance. The police have given up already, but Tarpon is too much of a gentleman to brush the old lady off. And when something smells off, he's not a man who can stop digging. Skeletons in the Closet takes the bruised and boozy detective of No Room at the Morgue even deeper into the wreckage of modern France. Manchette exposes a world where justice is hollow and decency is just another dead end. PRAISE FOR JEAN-PATRICK MANCHETTE'Writing so dark it gives a new meaning to the word noir' - Frederick Méziès'We must revere him now and rediscover him this very instant' - James Ellroy'A comedic genius...I read and reread him, stunned, appalled, and laughing out loud' - Rachel Kushner

Skeletons in the Closet

'Manchette was Le Homme...rediscover him this very instant' - James EllroyMeet Eugène Tarpon: ex-cop, ex-idealist, man in free fall. Kicked off the force for killing a protestor, Tarpon is drinking too much and waiting around for something to happen. Then it does. In bursts the wild-eyed and bloodstained Memphis Charles, whose roommate has been brutally murdered. And she wants no one but Tarpon on the case. As the bodies mount, Tarpon is dragged into a Parisian underworld of politics, sleaze, and paranoia - with nothing to guide him but instinct, stubbornness, and a battered sense of justice. With No Room at the Morgue, Manchette rewrote the American hardboiled detective novel into a bleak, boozy, and brilliantly French bruising meditation on guilt, truth, and the art of going down swinging.PRAISE FOR JEAN-PATRICK MANCHETTE'A comedic genius... I read and reread him, stunned, appalled, and laughing out loud' - Rachel Kushner'Manchette is one of the greatest writers since Dashiell Hammett, his only true son and heir' - David Peace'Manchette is Camus on overdrive... He deserves much the same attention' - James Sallis

No Room at the Morgue

'Searingly honest . . . compelling, hard to read and hard to put down' Literary Review 'A frank and moving story . . . an urgent plea' Telegraph'Who speaks? Who is able to make themselves heard? And if this fundamental political gesture remains inaccessible to so many people who figure among the most dominated, the most dispossessed, the most vulnerable, does it not fall to artists, writers and intellectuals to speak of them and for them'When Didier Eribon's mother began to lose her physical and cognitive autonomy, the author and his brothers were compelled to place her in a nursing home, despite their misgivings. A few weeks later, she died.In The Life, Old Age, and Death of a Working-Class Woman, Eribon embarks on a historical, political and personal meditation on what it means to grow old in our society, and the care we provide for those who cannot afford to pay for better services. Tracing his mother's rapid decline - and drawing on works by Simone de Beauvoir, Norbert Elias, Annie Ernaux and Michel Foucault, among others - Eribon offers an honest, original and wide-ranging exploration of the relationship between ageing, gender and class, transmuting his own rage, sadness and shame into a strikingly nuanced portrait of the most overlooked human experience.Translated by Michael Lucey
