"La gravedad de las penas debe ser relativa al estado de la nación misma. Más fuertes y sensibles deben ser las impresiones sobre los ánimos endurecidos de un pueblo recién salido del estado de barbarie. Al feroz león, que se revuelve al golpe de un arma limitada, lo abate el rayo. Pero a medida que los ánimos se suavizan en el estado de sociedad, crece la sensibilidad, y creciendo ésta, debe disminuirse la fuerza de la pena, siempre que quiera mantenerse una relación constante entre el objeto y la sensación."

Este tratado está considerado como uno de los libros más influyentes en la reforma del antiguo derecho penal continental. En el se exponen ideas que hoy se asocian con frecuencia a los fundamentos del derecho moderno (Las penas deben ser iguales para todos los ciudadanos; El poder legislativo y el judicial deben estar separados; No se debe aplicar castigos inhumanos...etc).

English description: "The severity of punishments must be proportionate to the condition of the nation itself. Stronger and more striking impressions may be required for a people newly emerged from barbarism. A fierce lion that resists the blow of a weak weapon is struck down by lightning. Yet as society grows more civilized, sensitivity increases; and as that sensitivity deepens, the harshness of punishment must diminish, if a just balance between offense and penalty is to be preserved."
Long regarded as a cornerstone of modern criminal justice, this powerful treatise challenged torture, arbitrary sentencing, and the death penalty at a time when such practices were widely accepted. Its arguments for proportional punishment, equality before the law, and the separation of legislative and judicial powers helped lay the intellectual foundations of contemporary legal reform.
