A Historical View

This book explores the historical, comparative and global dimensions of the constitutional phenomenon. From the origins of constitutionalism to the diverse trajectories of North American and European constitutionalism, the book considers pivotal moments in the emergence and evolution of formal Constitutions as the main structure of constitutional governance. It presents a critical inquiry into the realities that lie beneath the surface of formal constitutional documents. From the struggles for democratic governance in Latin America to Asia's delicate balance between tradition and modernity and Africa's post-colonial arrangements, the book poses a critical query: amidst the promises of democratic ideals, do formal Constitutions always translate into effective governance? What are the lessons of 'facade' Constitutions on the tension between formal documents and the realities of governance? The book explores the past and present of constitutional governance in the first quarter of the 21st century and offers insights on the future of constitutionalism. By assessing the normative quality of Constitutions and exploring the intrinsic link between them and representation, it offers an understanding of the essence and trajectories of constitutional thought and practice. This volume explores the state of representative democracy on the global stage. It does this against the backdrop of crises such as the USA Capitol attack on 6 January 2021, recent refusals to accept election results in various countries, and attempts to restrict the voting franchise, as well as longer-term trends such as the rise of populism and declining trust in political elites. The first substantive chapter examines representative democracy in theory, history and practice today. Taking the representative model as their point of departure, the subsequent chapters explore a range of themes in relation to this model. The contributions include timely reappraisals of democracy in countries, such as the UK and USA, with old, well-established democratic structures, as well as analyses of the state of democracy in regions such as Africa, Asia and South America, where democracy has had a more chequered history. Across all of its chapters, the book invites readers to rethink fundamental questions about representative democracy: Why is it valuable? How should it be organised? Do steps need to be taken to strengthen representative democracy, and if so, what are those steps? The volume's target audience - politicians, public servants and interested members of the public - are provided with arguments and evidence to form their own views at a time when the ideals and practices of representative democracy are being challenged around the world, and new ideas and initiatives to revitalise it are being debated and implemented.

Democracy in Crisis?

Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. In diesem Rahmen werden an den einschlagigen Dokumenten orientierte (verfassungs-) rechtliche, zeitlich wie territorial ubergreifende entwicklungsgeschichtliche Darstellungen vorgenommen. In dem hier vorliegenden 3. Band werden erstmals uber 450 Verfassungsdokumente prasentiert, welche fur die verfassungsstaatliche Entwicklung des Groherzogtums Berg und des Herzogtums Braunschweig pragend waren. Begleitet wird diese Textedition durch eine ausfuhrliche historische Einfuhrung.

 traces Argentina’s long ideological arc from the liberal foundations of the 1853 Constitution, through Peronism, military rule, neoliberal reform, and the interventionist turn after the 2001 collapse, to the two liberal “waves” that culminated in Milei’s election. Along the way, it unpacks the meanings of liberalism and libertarianism, contrasts them with their main rivals, and situates Milei within both national history and a broader global surge of anti-establishment leaders.
 
 The resulting book offers a new way to understand Javier Milei as a political actor—and Argentina as a country once again at a crossroads.
 Sebastián Álvarez
 is Professor at Universidad Adolfo Ibáñez in Chile and Associate Researcher at the Graduate Institute in Geneva, Switzerland. His work explores the history of finance and banking in Latin America, with particular attention to how capital markets shape economic policy and international relations. He is the author of 
 Mexican Banks and Foreign Finance
 (Palgrave Macmillan, 2019).
 Ezequiel Spector
 is Research Professor and Director of the Master of Arts program in Philosophy, Politics, and Economics at Adolfo Ibáñez University in Chile. He is the author of 
 Freedom as Social Cooperation

This open access book presents an all-encompassing way to understand lobbying: the 'Diversion Guide'. This shows that lobbying is problematic when institutions are diverted from acting in the public interest. It reveals why diversions happen, how they are linked together, and what can be done to prevent them. The reader can use the 'Diversion Guide' to identify any problem about lobbying, and test when an officeholder has been diverted from acting in the public interest. The book examines how lobbying can encourage citizen participation and lead to informed law and policy, but is not always fair. It considers the way in which wealthy and influential people can gain greater access to the United Kingdom's political system than most to shape the laws that govern everyone. Scandals are often reported in the media surrounding unequal access, corruption, the revolving door, and more. Unchecked, such lobbying corrodes trust in public institutions. It is vital that the problems surrounding lobbying are clearly understood to avoid a system of weak regulations and to ensure that better regulations are created to restore public trust in politics.
