Over the years, enforcement of public administration debt has been characterized by legislative attempts to reconcile, on the one hand, the creditor's individual interest in enforcing his right with, on the other, the requirement not to jeopardize, through the attack on public administration assets, the public interest in the performance of the administration's functions. Initially, the principle of separation of powers and the reservation recognized to the administration regarding the exercise of its powers led to doubts about the very admissibility, in the preliminary investigation phase and, therefore, prior to enforcement action, of the possibility of issuing a judgment of conviction against the public administration.
