Current Debates in Comparative and International Law

This book offers a critical and original examination of how the doctrine of superior responsibility has been interpreted and applied in international criminal law. It challenges prevailing scholarly approaches by shifting the focus from legal characterization to the doctrine’s conceptual components — an often overlooked but more pressing arena.
At the same time, by tracing the doctrine’s evolution from ancient military theory through religious and medieval legal traditions to its current position in international criminal law, the book interrogates the underlying tension between its nature as a form of vicarious liability and the principle of personal culpability central to criminal law theory — an approach the book critically examines, and perhaps ultimately rejects.
Rather than merely summarizing case law, the book explores how and why international tribunals — particularly the International Criminal Court in the landmark&nbsp;Bemba case — have applied the doctrine inconsistently. It engages with jurisprudence from ad hoc and hybrid tribunals to expose doctrinal ambiguities and recurring misapplications that undermine legal coherence and accountability.
An additional contribution of this work is the development of a syllogistic test for assessing superior responsibility in contexts involving human rights violations and treaty-based offenses. Balancing doctrinal critique with a normative analysis, the book offers a deeper theoretical and practical lens on one of international criminal law’s most debated areas.
Intended for legal scholars, practitioners and graduate students, this book is a valuable resource for anyone seeking a more principled and analytically rigorous understanding of superior responsibility in both historical and contemporary contexts.

Prosecuting Superior Responsibility in International Criminal Law

For what reasons does an obligation to surrender the contractual surrogate arise under §§ 285(1), 816(1), 818(1) and (2), and 822 of the German Civil Code (BGB)? Nathan Krian explores this question by examining the functional equivalents in the law of England and Wales. The insights gained from this analysis are then compared with the reasoning developed in German law in similar contexts, in order to make the value judgments of English law useful for the German legal discourse. Particularly revealing is the allocation function of contractual promises in English law, which is of special interest for explaining the obligation to surrender the contractual surrogate under § 285(1) BGB. In this context, Krian analyzes cases in which the allocation function of contractual promises is realized through tracing-especially in the context of the Vendor Purchaser Constructive Trust. To this end, the study first provides an overview of the trust as a legal institution and of the requirements of the Vendor Purchaser Constructive Trust and specific performance. Finally, the examination of the surrender of contractual surrogates in English law also includes a discussion of the concepts of disgorgement and damages, in order to present a comprehensive picture of the mechanisms giving rise to such claims.

Cross-border cooperation between tax authorities based on the EU Directive on Administrative Cooperation has been steadily expanded and intensified in recent years. This development is accompanied by numerous interferences with fundamental rights. However, the doctrinal foundations of fundamental rights in the area of tax enforcement within the European Union have so far received little systematic scholarly attention. Thomas Sendke examines this issue by analyzing fundamental rights protection in cross-border European tax enforcement and first determines the applicable fundamental rights standard of review. Clarifying the doctrinal interaction between the various fundamental rights regimes requires, in turn, an analysis of the current state of harmonization in tax enforcement. This reveals that EU fundamental rights already apply in many areas of (cross-border) tax enforcement.
 

 The author then compares the protection offered by the different fundamental rights regimes with regard to procedural burdens, before assessing specific tax enforcement measures against the standards he has developed. The analysis shows that, in many areas of cross-border tax enforcement, both Union and national fundamental rights already guarantee a sufficient level of protection - supported in part by recent case law of the CJEU. In other areas, however, fundamental rights protection remains inadequate. Overall, Thomas Sendke's work makes a significant contribution to the emergence of a European tax constitutional law.
