Die Geldwäscheprävention in der Europäischen Union ist seit jeher zentralistisch ausgestaltet. Der systematische Ansatz der Durchführung von Präventionsmaßnahmen über verpflichtete Marktteilnehmer stößt bei dezentral ausgestalteten Zahlungssystemen wie Bitcoin jedoch an seine Grenzen. Blockchain-basierte Transaktionen können ohne Einbindung von Intermediären direkt zwischen Sendern und Empfängern vollzogen werden und gehen so an der Präventionsregulierung vorbei. Mit dieser systematischen Krise der aktuellen Geldwäschepräventionsregulatorik setzt sich das Buch auseinander und erörtert nach ausführlicher Darstellung der technischen Besonderheiten der Blockchain-Technologie die europarechtliche Rechtmäßigkeit des aktuellen Regulierungsansatzes der EU im Bereich blockchain-basierter Zahlungssysteme. Daneben bietet der Autor einen praxistauglichen alternativen Regulierungsvorschlag an, der auch Transaktionen außerhalb des gegenwärtigen Verpflichtetenkreises erfassen würde.

Bitcoin, Ethereum, Uniswap or Tether are not just digitals currencies. Bitcoin is pure law. Since the emergence of the blockchain, it is possible to regulate ourselves in a decentralized, private way, with a law that is digital, self-regulating and self-executing. 

 Likewise, states, elites and official organizations repeat over and over again the same message from various platforms: Bitcoin is unregulated, it is only good for dirty business, it is merely speculative, etc. While we listen to these slogans, the price of Bitcoin continues to rise, unstoppable.
 
 We are witnessing the birth of a new law: internet law. Every era has its own legal system. Property law arose out of the settlement of agricultural societies. Commercial law was born in the Middle Ages. Corporate law flourished in the 17th century, thanks to the maritime mercantile business. Labour law appeared among the assembly lines of the factories of the Industrial Revolution. Digital laws, such as Bitcoin, are those of internet jurisdiction.
 
 Internet technology allows us to be sovereign, to issue digital laws in a decentralized way, and to organize ourselves through new institutions. It is our responsibility to seek social and legal solutions in line with the internet revolution. De nos jours, la monnaie officielle est redevenue un système de crédit-dette comme à l'ère sumérienne. Ce système, qui ne se reconnaît plus de limite, semble échapper à ses maîtres. L'apparition des taux d'intérêt négatifs fut une anomalie jamais rencontrée par le passé. De simples mortels peuvent-ils nier la valeur du temps que matérialisent les intérêts ? Die Arbeit untersucht, inwieweit MEV mit dem neu geschaffenen Marktmissbrauchsrecht für Kryptowerte der EU-Verordnung MiCAR vereinbar ist. Hierbei werden die vier MEV-Methoden des Sandwichhandels, der DEX-Arbitragen, der Liquidierungen und der Anordnung der Transaktionskette beleuchtet. Die Arbeit zeigt praxisnahe auf, inwieweit sich die jeweiligen Akteure im Rahmen eines MEV-Handels wegen Marktmanipulation und Insiderhandels strafbar machen. Zugleich wird lösungsorientiert die Grenze zulässigen Verhaltens definiert.
Die Arbeit wurde mit dem Förderpreis 2026 der Heinz-Ansmann Stiftung ausgezeichnet.
