Die Nebenintervention im selbständigen Beweisverfahren

»The Third-Party Intervention in the Independent Proceedings for the Taking of Evidence«: The third-party intervention serves to involve an affected third party who is not a party to the legal dispute. German law requires a pendency of legal dispute between two other parties for this purpose (§ 66 subs. 1 ZPO). Since the independent proceedings for the taking of evidence is not such a legal dispute, this study examines the application of the provisions on third-party intervention in the regular litigation procedure to the independent proceedings for the taking of evidence.
