This book considers whether news gatherers should be required to disclose the identity of anonymous sources used in their stories by courts or other bodies. The vast majority of media self-regulatory codes impose an obligation not to disclose the identity of such sources, but many legal systems have traditionally been reluctant to offer such a degree of protection to anonymous sources, or any at all. However, the latter part of the twentieth century and early twenty-first century has seen an explosion in the number of such 'source protection' laws, and much judicial and legislative activity to change existing laws.Drawing on media and communications theories the book identifies a number of different theoretical justifications for source protection laws and analyzes whether the application of existing laws are consistent with any of these theories. Using legal materials and codes from a wide variety of countries it considers whether there are any noticeable trends in how different countries address this issue. It explores the influence of the United States and the European Court of Human Rights' jurisprudence on the matter beyond their jurisdictions, and asks the question whether this is an area of law captured by 'globalisation,' or whether countries with different constitutional and media traditions have developed different approaches to 'source protection.'Finally having assess the arguments in support of source protection laws Damian Carney puts forward a model clause and model shield law for the protection of anonymous sources which is theoretically and practically robust.

Responsibility Accountability Maritime Law examines the phenomenon of criminalisation which confronts the Master in their professional conduct, both in terms of Flag State and Port State rights and obligations. The fault lines of criminalisation, which go to the heart of the question, demand an understanding of how the concept of criminal justice has evolved to impose accountability on the Master, in circumstances which had not been crimes before.Since this book was first published, the maritime world has changed dramatically, requiring a new understanding of responsibility and accountability before the Master can make rational decisions to respond to the risk of criminalisation. Das Skript enthält eine systematische Darstellung des Verwaltungsprozessrechts, die sich an den Bedürfnissen von Studierenden orientiert. Es wendet sich an Anfänger zur Vorbereitung auf universitäre Klausuren und Examenskandidaten gleichermaßen, indem es zunächst die Grundstrukturen erklärt, um sodann das examensnotwendige Detailwissen darzustellen. Didaktisches Ziel dieses Skripts ist es, Klausurwissen und Klausurtechnik zu vermitteln.

Zu diesem Zweck ist das Skript in vier Schritte unterteilt:

1. Schritt: Kurze Einführung zu jedem Themengebiet

2. Schritt: Prüfungsschema
Das Prüfungsschema zeigt auf einen Blick, wie das in dem Kapitel vermittelte Wissen in den Prüfungsaufbau einer Klausur einzubringen ist.

3. Schritt: Examensrelevantes Wissen systematisch-strukturiert
Vertiefte Darstellung der Definitionen und Probleme des Verwaltungsprozessrechts. Zum besseren Verständnis finden sich anschauliche Beispiele und Merksätze. Dieser Abschnitt vermittelt sowohl dem Anfänger das Basiswissen des Verwaltungsprozessrechts als auch dem Examenskandidaten die im Examen geforderten vertieften Kenntnisse. Marginalien am Rande dienen der schnellen Orientierung, ohne den Lesefluss zu stören.

4. Schritt: Klausurfall auf Examensniveau
Am Ende eines Kapitels kommt ein Klausurfall, der Examensniveau aufweist und dem Leser zur Kontrolle dient, ob er das erlernte Wissen in einer Klausur umsetzen kann.

This book offers a critical and timely account of how labour law has become a means for protecting employers rather than workers.The past few decades have witnessed something of a 'silent revolution' in the traditional protective role that labour law has played in the lives of workers. While this transformation has been overt in the realm of the market and at the level of the legislature, the role of the judiciary in this process remains significantly under-studied. Focussing on Australia, but drawing also on material from New Zealand, the UK and Canada, this book investigates how the common law has intervened to shape labour law in the image of commercial contract, determining disputes and defining legal issues by ignoring the realities of working life. Under this new conception of labour law, industrial relations between workers and employers are rarely reciprocal or relational. Rather, they are determined by the legal meaning and purpose of the contract of employment, drafted by lawyers for the benefit of employers and their human resources departments.
