It demonstrates that the principle operates as a meta-norm governing the applicability of statutory minimum employment standards. The analysis focuses on neutral, ambivalent and variably favourable contractual clauses. Ambivalent and time-dependent deviations are shown to fall below the statutory minimum standard and to be invalid.
