The core of Taiwan's (Republic of China) current criminal law essentially stems from 19th-century European legal thinking. This book explains the unique development of a sui generis legal system in Asia. It provides readers with an understanding of Taiwan's criminal law in its historical, political and social context. Subsequently, selected features of Taiwanese criminal law are compared with Swiss criminal law principles. Of interest here are fundamental principles of criminal law on the one hand and specific provisions in the respective national statutes on the other. Finally, insights and predictions for both criminal law systems can be derived from the comparative law analysis.
