Ce manuel universitaire, intitulé ' Cours d'Encyclopédie du Droit : Introduction Générale à l'Étude du Droit ', offre une exploration méthodique des fondations du savoir juridique. L'ouvrage s'adresse spécifiquement aux étudiants en début de cursus, leur fournissant les outils conceptuels nécessaires pour naviguer dans l'ensemble complexe des sciences juridiques, avec une orientation particulière vers les législations belge et française du XIXe siècle.La première partie est dédiée à l'analyse du droit en général et à ses manifestations. Le droit politique englobe le droit constitutionnel (l'organisation de l'État, la souveraineté nationale, et les droits fondamentaux garantis par la Constitution belge, tels que l'égalité, la liberté individuelle, le droit de propriété et la liberté des cultes), le droit public organique, et un examen détaillé du droit administratif, y compris le droit de police et de finance. Enfin, le droit international (public et privé) est présenté, traitant des sources (traités), de la diplomatie (exterritorialité des agents) et des principes régissant les rapports privés transnationaux.

Oppositionsklage im Exekutionsverfahren: Dogmatische Analyse zu Einwendungen und Streitgegenstand

 Die Oppositionsklage ist ein zentrales Instrument zur Wahrung des Rechtsschutzes der im Exekutionsverfahren verpflichteten Partei: Sie gewährleistet die Geltendmachung von Einwendungen gegen den dem Exekutionstitel zugrundeliegenden Anspruch im Exekutionsstadium. Wenngleich die Rechtsprechung des OGH zu vielen Fragen der Oppositionsklage als gefestigt bezeichnet werden kann, stößt sie in der Lehre häufig auf Kritik. Dadurch verbleibt in zahlreichen Punkten dennoch Rechtsunsicherheit.Diese Monografie behandelt zwei ausgewählte Problemkomplexe der Oppositionsklage und arbeitet diese dogmatisch fundiert und ganzheitlich auf. Der Fokus liegt dabei auf der Fragestellung, unter welchen Voraussetzungen eine materiellrechtliche Einwendung einen tauglichen Oppositionsklagegrund bilden kann - wobei zu differenzieren ist, ob die Exekution aufgrund eines rechtskräftigen oder eines nicht rechtskraftfähigen Exekutionstitels bewilligt wurde. Darüber hinaus untersucht die Arbeit das bereits vieldiskutierte Problem, wie der Streitgegenstand der Oppositionsklage zu begrenzen ist.

Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. The EU is undergoing one of the most profound structural crises of its history, relating to the rule of law and fundamental rights. The author conceptualises the existential question in terms of ontology, constitutional legitimacy, doctrine and institutional process. By providing the first conceptual methodology (based on comparative federalism and focusing on law and rights) the book develops proposals which can be used to address the EU's current constitutional challenges.
