The Mind Beyond Good and Evil

Vulnerability theory identifies structural and institutional factors that build or undermine the resilience of individuals and organisations. This volume uses vulnerability theory to explore how the organisation of the teaching and research activities of universities impact the resilience of academics and also how these activities themselves are impacted by contemporary developments in universities and educational policy.The starting point of enquiry is that neither academics nor universities are invulnerable, and that urgent attention is needed to reverse developments that undermine their resilience. The contributions focus on universities in the US and UK, legal education in the UK, criminal justice in the UK, Brazilian legal education, research in deprived communities, and the ethics of medical professionals. This broad range of subjects is connected by use of vulnerability theory to interrogate academic practices and universities as organisations which should build resilience in their workforce and communities and in so doing secure their own resilience, but which far too often fail to do so, and actually undermine resilience. It is argued this is not due to malefic intentions but to institutional features of the sector and society. Of immediate interest to anyone who works in, studies at, or relies upon the research mission of universities, and to those involved in the management of universities, this book will also be relevant to policy analysts and policymakers, who will find value in the reframing of vital issues in higher education policy by vulnerability theory, allowing a more realistic and productive policy environment to develop. Principles of Medical Law

People with mental illnesses in the United States are 10 times more likely to be incarcerated than hospitalized. In fact, seventy percent of individuals in jail in the United States have a serious mental illness, a substance use disorder, or both. After confronting the failures of our criminal justice system first-hand, Miami-Dade County (Florida) Judge Steven Leifman realized that for the system to improve, a radical change was necessary. In 2000, he created Florida’s 11th Judicial Circuit Criminal Mental Health Project, later renamed to the Jail Diversion Project (JDP), which has since become the most impactful model for prison reform in the country and garnered international accolades. Complete Justice reveals Judge Leifman’s courageous and visionary efforts to successfully overhaul and restructure Miami-Dade’s mental health and criminal justice systems. The results were nothing short of miraculous. Arrests were cut in half, the jail audit was reduced by almost half, police shootings almost stopped, and the county was able to close one of its three main jails at a savings of millions of dollars. Best of all, his results are replicable and scalable. Leifman has created a state-of-the-art, transferable model, the “Miami Model,” that is starting to be applied around the country in communities large and small. This highly successful initiative, consisting of both pre-arrest and post-arrest diversion programs, brings together the resources and services of law enforcement, the justice system, and community stakeholders to divert individuals with mental illnesses who commit low-level offenses away from incarceration and into community-based care. Starting with a trip to a psychiatric wing of a Florida jail at age 17, through his early missteps as a young judge bumping up against convoluted the mental health legislature, the formation of the JDP and monumental report on Florida’s mental health system, and finally spotlighting courts across the country adopting his program, Leifman’s inspiring work offers kindness, insight, and real solutions to one of America’s most complex social problems.

Supporting Legal Capacity in Socio-Legal Context

A troubling account of the unexpected impacts of treatment-based alternatives to criminal punishment. Every year, courts send hundreds of thousands of people to treatment-based programs as alternatives to traditional punishment. These alternatives--known as 'diversion programs'--are widely celebrated as reforms that reduce the punishment of the mentally ill. But in Trial by Treatment, Mary Ellen Stitt shows that they have, in fact, expanded the reach of the criminal legal system and its power over the lives of the most vulnerable. The inner workings of diversion programs are obscure, partially by design, and data on outcomes is hard to come by. Stitt draws on two years of fieldwork in criminal courtrooms and court-mandated treatment sessions, as well as an original national dataset, in-depth interviews, and experimental survey data, to document the hidden impacts of diversion. She shows that placing mental healthcare under the control of the courts has helped to legitimize the criminalization of illness, warped treatment environments, and amplified inequalities in punishment. New Advances in Crime and Social Harm

Debates about the regulation of drugs are inseparable from talk of children and the young. Yet how has this association come to be so strong, and why does it have so much explanatory, rhetorical and political force? The premise for this book is that the relationship between drugs and childhood merits more exploration beyond simply pointing out that children and drugs are both 'things we tend to get worried about'. It asks what is at stake when legislators, lobbyists and decision-makers revert to claims about children in order to sustain a given legal or policy position. Beginning with a genealogy of the relationship between the discursive artefacts of 'drugs' and 'childhood', the book draws on Foucauldian methodologies to explore how childhood functions as a device in the biopolitical management of drug use(rs) and supply. In addition to analysing decriminalisation initiatives and sentencing measures, it (unusually) reaches beyond the criminal context to consider the significance of the 'politics of childhood' for law- and policymaking in the fields of family justice and education. It concludes by arguing that the currency of childhood and 'youth' is not reducible to rhetoric; it shapes the discursive entities of drugs and addiction and is one of the ways in which particular substances become socially, culturally and politically intelligible. At the same time, 'drugs' serve as a technology of child normalisation.
