Datenrecht und neue Technologien

Vor dem Hintergrund rückläufiger Eingangszahlen an den Zivilgerichten und der wachsenden Bedeutung privater Streitbeilegungsplattformen analysiert die Arbeit das Potenzial KI-gestützter Entscheidungssysteme zur Entlastung der Justiz. Sie analysiert die Ursachen des Rückgangs und diskutiert gesetzgeberische Reformansätze. Eine erfolgreiche Reform könnte die Fallzahlen zwar steigern, zugleich aber die justiziellen Ressourcen zusätzlich belasten. Um dieser potenziellen Überlastung zu begegnen, identifiziert die Arbeit KI-Werkzeuge als Schlüsseltechnologie im Rahmen der richterlichen Entscheidungsfindung und analysiert die damit verbundenen technischen und verfassungsrechtlichen Rahmenbedingungen.

This book provides the first comprehensive analysis on the shared international responsibility of multiple states and international organizations that contribute to a single refoulement. It develops a set of Guiding Principles on the determination of shared responsibility for multi-actor contribution to a refoulement, based on the progressive development of the law of international responsibility. The book initially explores how destination states engage with transit states and international organizations (the European Union, NATO, the United Nations and the International Organization for Migration) in refoulements. It then analyses why existing legal instruments, notably the International Law Commission’s Articles on International Responsibility and the Guiding Principles on Shared Responsibility in International Law, fail to address such complex scenarios. Building on this critique, the book proposes new Guiding Principles and demonstrates how they can be applied in practical scenarios, offering guidance for scholars, practitioners, judges and policymakers working in human rights and refugee law.

This book explores the impact of the European Convention on Human Rights (ECHR) when defining and protecting pension entitlements as property rights. The sustainability of pension systems in Europe is threatened by mounting public debt and demographic shifts. In recent decades, governments have addressed these challenges by implementing reforms to balance financial stability and guarantee adequate retirement benefits. Many of these reforms have faced legal challenges from activists and lawyers in domestic courts, based on 'stand-still' and 'non-retrogression' constitutional principles. However, Article 1 of Protocol No. 1 of the ECHR offers an alternative approach that protects social security entitlements, including pensions, as private property, deserving of protection against unjustified state interference. This book explores the historical legal rationale employed by the Court to establish social security entitlements as private property. It further examines how the Court has assessed reforms through a proportionality assessment that weights public interests against individual rights. This analysis distils key principles such as reasonableness, non-discrimination, and fair distribution of burdens that can guide policymakers towards responsible, rights-compliant reform. This open access book addresses the application of EU fundamental rights law by national courts. It offers a unique insight into the case law of courts in three EU Member States (Belgium, Germany and the Netherlands) as regards mutual trust and fundamental rights. Through a thorough analysis of over 1000 national court judgements from the last ten years, the book enables readers to view EU law from the perspective of national judges.
The book focuses on decisions regarding transfers under the Dublin Regulation and the European Arrest Warrant. These particular cases require national judges to balance the EU legal principle of mutual trust with individual fundamental rights. This is a demanding task due to the differences in approach between the Court of Justice and the European Court of Human Rights, as well as the inherent tension between the principle of mutual trust and fundamental rights. The book investigates how national judges navigate the differences in applicable laws (EU law, ECHR law, national law) in Dublin and EAW cases. Moreover, it dissects how and when national judges decide to allow or refuse a transfer, along with their legal reasoning. Finally, the manner in which national courts have utilised the preliminary reference procedure in these cases is considered.
