This book presents an in-depth interrogation of the theory and application of the Basic Structure Doctrine in the Federation of Malaysia. The Basic Structure Doctrine, famously introduced in the 1973 Indian Supreme decision of Kesavananda Bharati v State of Kerala AIR - which held that certain core or fundamental features in the Constitution of India could not be amended by Parliament even if it met all procedural requirements - was initially rejected when it was first argued in Malaysia in the 1975 case of Loh Kooi Choon v Government of Malaysia and lay dormant for the next three decades. Judicial winds shifted in 2010 when Malaysia's apex court, the Federal Court, cited Kesavananda with approval in the case of Sivarasa Rasiah v Badan Peguam Malaysia &amp; Anor, and observed that it was 'clear from the way in which the Federal Constitution is constructed that there are certain features that constitute its basic fabric' and that 'any statute (including one amending the Constitution) that offends the basic structure may be struck down as unconstitutional.' In a quick succession of cases, the Federal Court cemented this doctrine in Malaysia's jurisprudence and deployed it to defend the court's judicial power. These widely-publicised cases generated much debate beyond the legal fraternity and judiciary and often polarised different sectors of Malaysian society. This collection of essays responds to this extremely important debate on the limits of constitutional amendments as a form of constitution-making in Malaysia by considering the theory behind the Basic Structure Doctrine and critically examining how it has been harnessed by the Federal Court and by other political actors - most notably Islamists and secularists; and royalists and republicans - on the ground.

Title 46 presents regulations applied by the Coast Guard to merchant marine officers and seamen, uninspected vessels, tank vessels, load lines, marine engineering, documenting and measuring vessels, passenger vessels, cargo and miscellaneous vessels, offshore supply vessels, mobile offshore drilling units, electrical engineering, small passenger vessels, oceanographic vessels, occupational safety and health standards, and lifesaving systems. Maritime Administration regulations cover policies, practices and procedures, maritime carriers, subsidized vessels, vessel financing assistance, emergency operations, training, and ports. The Rule of Law in Context

How and why do the rule of law ideas shape the origins and functioning of the Russian state and society? 

This book explores how, over two centuries, the Russian meaning of the rule of law has been reflected in the legal doctrine, legislation, formal and informal practices of legal and political institutions, and also everyday life and the perceptions of Russian citizens at large and certain minority groups. 

The authors argue that legal dualism – the tension between constitutionalism and political expediency – explains the rise and fall of multiple ways in which the parts of the Russian state interact with each other and with citizens, and in which citizens and businesses interact among themselves both at home and abroad. 

Explaining the peaceful co-existence of these multiple ways of law, this book goes beyond the mainstream accounts of instrumental uses of law and lawlessness in Russia and offers novel ways of understanding the myriad ways in which law may matter in authoritarian regimes.

The university is a foundational institution in society and a cornerstone of democracy. However, recent actions taken by the Trump administration pose an existential threat to this institution by undermining its singular animating right: academic freedom. In Academic Freedom in the Era of Trump, preeminent thinkers draw from their experience as university leaders and First Amendment scholars to portray this troubling moment for academic freedom. The volume examines the legal, historical, and philosophical foundations of academic freedom, its First Amendment roots, and the implications of recent political interference. The Supreme Court has now enshrined the principle of academic freedom within our First Amendment jurisprudence, unceasingly affirming the principle while continuing to refine its contours. Yet, the Trump administration has employed an authoritarian playbook to assault this principle, withholding federal research funding and exploiting antidiscrimination laws, among other tactics. To prevail in this moment, universities must defend academic freedom by clarifying and reaffirming the constitutional origins, emphasizing the indispensable societal role, and refining and articulating the distinct culture and structures of universities that allow the principle to flourish. Master's Thesis from the year 2025 in the subject Leadership and Human Resources - Recruiting, grade: 1,2, University of Applied Sciences Dortmund, language: English, abstract: This master's thesis explores the role of artificial intelligence (AI) in modern recruitment processes with a particular focus on applicants' trust. As digitalization and AI increasingly transform the world of work, organizations are adopting AI-supported recruiting tools to enhance efficiency, standardization, and data-driven decision-making. At the same time, the use of AI in personnel selection raises important questions regarding transparency, fairness, and acceptance from the applicants' perspective.

The objective of this thesis is to examine how applicants perceive AI-assisted recruitment processes and which aspects are relevant for the development of trust in this context. To address this research objective, a qualitative research design was chosen. Semi-structured interviews were conducted with participants who had either experienced AI-supported recruitment processes or reflected on their expectations toward such processes.

The empirical data were analyzed using qualitative content analysis following Kuckartz' approach. This method allows for a systematic examination of subjective perceptions, attitudes, and evaluations, while combining theory-driven and data-driven coding. The analysis focuses on applicants' experiences with different forms of AI usage in recruitment, their expectations toward human and technological decision-making, and their assessment of AI-supported processes within the broader candidate journey.

By linking theoretical concepts of trust in technology with empirical insights from applicants, this thesis contributes to the growing body of literature on AI in recruiting. In addition, it provides a structured foundation for further academic research and offers valuable insights for organizations seeking to better understand applicant perspectives on AI-supported recruitment processes.
