An Introduction to Public International Law

This book examines the constitutional treatment of national security in the UK, Canada, Australia and New Zealand. These four states share their Commonwealth heritage and are members, alongside the USA, of the Five Eyes intelligence-sharing alliance. The book takes a comparative approach to the institutions through which, and tools with which, these four states seek to protect their national security against the threats of both terrorism and hostile state activity and how they have evolved over time. It identifies and examines the various specialised institutions, inside and outside of legislatures, which have grown up to oversee the exercise of public power for national security purposes while maintaining the required secrecy. It argues that the extent of the borrowing and sharing between these jurisdictions in the domain of national security, now and in the past, permits us to talk about a Commonwealth model of national security constitutionalism.

In the face of the largest displacement crisis on record even the most optimistic view of the future suggests that in the years ahead, more and more people will migrate in order to survive. The world requires places where refugees and other migrants forced to leave their homes have the opportunity to work, study, create, start businesses, and rebuild new lives for themselves and their families. Free Global Cities can deal with this growing global crisis in a completely new way. They are autonomous, self-governed subnational entities that provide a safe environment and rule of law that will create wealth and prosperity for its residents as well as for the nations hosting them. Such a model would contribute significantly to handle the largest migration crisis in history, which the world will be experiencing in the coming decades.

East Asia is shaped as much by identity-based dynamics as by material forces. This book examines how the evolving state identities of China and Japan have interacted with the regional order and its prospects for both cooperation and conflict.While identity-based dynamics have long been recognised as enduring features by observers of East Asia, conventional accounts often emphasise the absence of a shared identity, persistent historical grievances, and nationalism-fuelled territorial disputes-particularly between China and Japan-as key obstacles to regional cooperation. Geographical Indications (GIs), widely used in the European context, are being promoted as vehicles for local development: but do they truly serve the interests of the Global South? Humanity in the twenty-first century faces serious global challenges and crises, including pandemics, nuclear proliferation, violent extremism, refugee migration, and climate change. None of these calamities can be averted without robust international cooperation.&nbsp;Yet, national leaders often assume that because their states are sovereign under international law, they are free to opt in or out of international cooperation as they see fit. This book challenges conventional wisdom by showing that international law requires states to cooperate with one another to address matters of international concern-even in the absence of treaty-based obligations. Within the past several decades, requirements to cooperate have become firmly embedded in the international legal regimes governing oceans, transboundary rivers, disputed territories, pollution, international security, and human rights, among other topics. Whenever states address matters of common concern, international law requires that they work together as good neighbors for their mutual benefit. This book explores why liberal democratic states like Australia and the United States continue to engage in practices that contest and risk violating the principle of non-refoulement, despite the oversight of courts, legislatures, and other decision-making bodies. The book demonstrates that understanding street-level bureaucrats and the organisations within which they work as outlets for applying rules developed by high-level political and international bodies ignores the potentially significant role that these actors play in interpreting, contesting, and ultimately shaping transnational law. Both Australia and the United States have developed and implemented asylum-seeker deterrence policies throughout conservative and progressive administrations. Both states have also built significant bureaucratic structures to implement asylum and refugee law systems, which they have located primarily within the national security apparatus of government. The national security context is key to understanding the motivations and constraints that street-level bureaucrats face, including how their decision-making is structured, rules regarding hiring and job-performance, agency culture, as well as laws and policies prescribing when and how asylum seekers may access international protection. In detailed, comparative case studies of Australia and the United States, the book uses social network analysis to challenge the idea of a gap between law and practice, while orienting readers to ways in which organisations interact as part of the asylum system and provide opportunities for street-level bureaucrats to understand, interpret, and contest international legal norms.
