Blackstone's Guide to the Anti-Terrorism Legislation

Translation, Interpreting and Social Justice in a Globalised World

Offers unique insights into the justice system, its power and the abuses that can happen to marginalised people when they intersect with the justice system. This book explores how minority language users experience access to justice and the right to a fair trial when they use their language in the criminal justice system. It investigates the lived experiences of Irish speakers and deaf Irish Sign Language users who have directly interacted with the criminal justice system. Treating identity as both internally constructed and externally imposed, it focuses on the issues raised when internally constructed identities are misunderstood, oversimplified and misused by the majority or the authority. The two case studies presented here investigate three layers of access to justice: procedural access, substantive access and symbolic access. This lens reveals the areas where, in spite of legal protections to safeguard fairness, minority language users still experience unequal treatment. The book provides a nuanced understanding of the experiences of minority language users and will be of interest to researchers in translation and interpreting, sociolinguistics and human rights law.

EU Administrative Law covers all dimensions of the administrative system in the EU and the principles of judicial review that apply in this area. The Law of Financial Crime

Following the events of 9\11 individual countries and the international community became increasingly concerned about how best to prevent the funding of terrorist groups. Alternative remittance systems such as Hawala, where money is moved informally between a network of brokers in the Middle East, north Africa and south Asia have been identified as a potential source of terrorist financing leading to calls for greater regulation of such alternative remittance systems.This book analyses the risk such alternative remittance systems pose in terms of terrorist financing, offering a detailed overview of the historical origins and methods of operation of alternative remittance systems or informal value transfer systems. The factors that have come to ensure that these systems have remained operationally viable in modern times are identified along with the risks they present balanced against an overview of their actual misuse for illicit purposes to date. The book presents a detailed critique of the UK framework for the regulation of these systems drawing where possible on existing data to assess the use and effectiveness of these measures in practice. A range of options for mitigating risks associated with specific remittance corridors is considered ranging from initiatives that promote remittances through the banking sector, to efforts to mitigate risk and the impact on the delivery of UK overseas development aid. The book concludes with key recommendations as to the effectiveness of the current regulatory framework within the UK viewed from the perspective of international efforts to secure the regulation of these systems, and in stemming terrorist finance as part of national and international counter-terrorism policy.

The Regulation of Hawala and Alternative Remittance Systems

Stemming Terrorist Finance

Money in political campaigns is a subject of endless current interest and enormous consequence for American democracy. Beginning in 1976, in Buckley v. Valeo, the Supreme Court established a framework for public campaign regulation that declared that money constitutes "speech" and that the only constitutional basis upon which the government can regulate money was to prohibit corruption or the appearance of corruption. The Court then defined corruption narrowly and held that direct "contributions" to candidates could be limited on that basis but that "expenditures," by political candidates and others, could not. Over time as the role of money became more and more serious in politics the Court in a number of decisions seemed to be turning more willing to accept regulation. But in Citizens United v. Federal Election Commission, the new conservative Supreme Court sharply turned against permitting regulation, including of corporations. Today that regime of nearly full protection for anyone spending virtually any amount of money for or against candidates and issues remains securely in place. The question, after a half century of this system, is whether this interpretation of the First Amendment is sound or not. If yes, then what are the justifications and what will be the consequences? If not, then what are alternative interpretations and what would the world be like under each one? The contributors, all scholars and experts in this area, give their interpretations and proposals.

Money, Politics, and the First Amendment

This book offers the first ever in-depth analysis of the emerging constitutionalism in South Sudan and the challenges it faces. The book critically analyses the constitution-making processes that occurred in South Sudan between 2005 and 2011, finding, among other things, that there was a failure of constitutional discourse, particularly in relation to the 2011 drafting process of the Transitional Constitution. It goes on to analyse how the constitution is being implemented. It finds that, despite the clear division of powers and functions between the national government and the sub-national governments, what has emerged in South Sudan in the post-constitution-making period is a form of coercive centralism where the national government controls much of the political decision-making process. This has had serious implications for democracy, constitutionalism, and the rule of law. Finally, bearing in mind the failure in both how the transitional constitution was made and how it is being implemented, the book undertakes a critical analysis of the proposed process for drafting a new constitution for South Sudan. It identifies serious shortcomings and proposes how these could be addressed to enhance the process.

Prevention of an erosion of the rule of law is of utmost importance for democracy, because once autocratization begins, only one in five democracies manage to avert breakdown. This book offers a means of protecting the rule of law and counteracting its misuse for illiberal purpose. It analyses inherent anomalies that occur in so-called consolidated democracies, and the responses where the rule of law is seriously undermined. Only by identifying legal imperfections and addressing them, can crises of liberal democracies be avoided. This book offers a fresh feminist perspective on prostitution. It challenges the 'sex work' perspective, drawing on experience from rape law and #MeToo campaigns in Ireland and elsewhere to develop a new legal concept of 'compromised consent'. This concept justifies the introduction of Nordic Model laws banning the purchase of sex. It recognises that an individual consent to sell sex is necessarily compromised by structural exploitation within the vastly profitable global sex industry. While 'sex work' proponents increasingly dominate academic discourse on prostitution, this book asserts that they have co-opted the language of feminism to mask the immense power and patriarchal control exerted by the industry. Their view of 'consent' is based on a dangerous premise. They cannot say that those who sell sex do so out of mutual desire; rather consent is portrayed as an expression of individual choice, thus ignoring the intersectional gendered collective context within which commercial sex transactions take place worldwide. By contrast, this book argues that presumptions of 'consent' in prostitution directly undermine the legal principles of affirmative consent and contemporary law reforms hard-won by feminist activists on rape and gender-based violence. A view of consent as 'compromised' within the sex trade derives from socialist theorising, as well as from legal re-conceptualisations of consent in other settings. It also reflects the reality of conditions within the sex industry. This book will be of great interest to students, academics, policy makers and feminist activists. It makes a significant contribution in challenging the dominant thinking within a highly polarised literature.
