Big Data and the Abuse of Dominance by Multi-Sided Platforms

An Analysis of Art. 102 TFEU

Inhalt

The author thoroughly examines the ability of Art.102 TFEU to protect competition against the abusive conduct by dominant platforms in an interdisciplinary manner. The initial part of the study clarifies the fundamentals of digital economy, especially Big Data and multi-sided platforms. The subsequent part elaborates on the relevant concepts that have been developed by the Commission and EU Courts in their decision-making practice on the interpretation of Art.102 TFEU, so as to assess their suitability for the prohibition of abuse by platform operators in the light of the intricacies of multi-sided markets. The existence and delimitation of a data market has also been innovatively discussed.
